Claims against Ryanair barred pilot from promotion

A SENIOR member of Ryanair management yesterday admitted that a former pilot was unable to enter into an internal promotion process because he was pursuing claims against the airline.

Peter Bellew, Ryanair’s general manager of flight operations, told an Employment Appeals Tribunal that the claimant, Joe Peard, could not have truthfully signed a bond required to enter into the upgrade programme without dropping his claims against the company. Mr Peard claims he was forced to leave the airline as he was subjected to a “systematic and ongoing campaign of harassment”. He worked with Ryanair for over four years before handing in his notice on June 29th, 2007.

The pilot says Ryanair denied him promotion to the rank of captain, even though he met the required criteria, manipulated the staff roster to reduce his pay and deliberately underpaid him. Ryanair contests the allegations.

Mr Peard believes the issues arose because of his involvement in a number of victimisation cases being taken by staff against the airline, and said he understood he would not be promoted unless his claims were dropped.

The tribunal heard that Mr Peard had completed the flying hours required to be promoted from the rank of first officer to captain in May 2006, but that he did not participate in a command upgrade programme that took place at about that time.

Ryanair then decided, in October of that year, to promote 20 pilots at its Dublin base to the rank of captain. Mr Bellew said a memo detailing the promotion process was sent to eligible staff and that this included a bond which applicants were expected to sign stating they had no claims against the company.

The tribunal heard that a number of other pilots who had claims against the airline had dropped their actions and been accepted into the promotion process, and that when Mr Peard sought clarification on the matter he was again asked if he had claims and if he would sign the bond. Mr Bellew denied there was any policy in place at the airline to limit the progress of staff who had outstanding claims, but admitted that he had helped to draw up the bond which sought “clarity” as to the status of the actions. He said he felt the bond was reasonable.

“We wanted to know where we stood with the employee before they were promoted,” Mr Bellew said. “We did not want legal claims involved in a promotion to a significant position.” Mr Peard’s representative, Michael Landers of the Impact trade union, said the bond was designed to ensure the number of claims outstanding against Ryanair was zero.

Tribunal chair Niamh O’Carroll Kelly said it appeared that “regardless” of what happened, Mr Peard could not enter the process without withdrawing his claim. She said there was no evidence that Mr Peard could enter the process and maintain his legal actions against Ryanair.

Ms O’Carroll Kelly said a Ryanair document included in the book of evidence stated that there would be no “impediments” to any pilot’s career progress. Sheadjourned the case until June 17th.

You are dead right inveritas. But the real Robert Mugabe is Michael O'Leary who thrives on intimidating staff, bullying, lying, cheating his own employees, creating a group of cronies around him to do his bidding. However what goes around comes around..inevitably he will be exposed for the fraud he is. Already there are court cases waiting to come through exposing the greed and corrupt practices of O'Leary and friends. Bankers pale in comparison! Sadly the pilot body and indeed other staff have to suffer in the interim.

'Take one for the team' it looks like. The more of these cases being made public, hopefully, the more exposure such practices will receive.

But will people go elsewhere and pay more in protest? That's the reality of it unfortunately.

From an Employment Law background, its rare to see such a clear cut case of victimisation.

Don't know about "back to your family in Ireland". The last one (holding the same position coincidentaly ) who "took one for the team" ended up eating more curry than he was used to :D

Is it really a democratic pilot ballot when your ERC says vote for this deal or face Bellew's "armageddon" of pay cuts, allowance losses and 6/2 rosters.

I don't know how long you have been in Ryanair, & I assume you did your homework before joining ? does any of this REALLY surprise you ? come on . . . big recession / business model perhaps not performing as well as they would like / market flooded with experienced & type rated pilots . . . really . . what did you expect ?

Of course this may be the biggest Pyrrhic victory yet won by Ryanair.

Firstly the variation of the Ts & Cs of the existing agreement was enforced before the conditions invoking any amendment occurred.

Secondly the new "agreement" varies the Ts and Cs of existing contracts which can't be achieved without individual negotiation!

Wood and trees is the obvious analogy!

Pay Deal Letter to Pilots
 

I was recently shown a letter form FR to pilots after the vote on the new pay deal.

Did anyone else find it slightly strange that the official letter from the Management was dated the day before voting had been officially completed??

Further to this, has anyone seen the actual official results and counts?


All I can say guys is PLEASE JOIN BALPA. If all full time FR pilots joined, then the company would be forced to accept a union. BALPA will act as the union representation, but only if they know that the pilots are behind them. Join and then it is AUTOMATIC!!
If enough FR pilots join BALPA, recognition is AUTOMATIC! Ryanair will HAVE to accept it and negotiate with the FR pilots in a real way rather then an ERC way.

For the first year guys it is 0.5% percent of your salary. that works out at a MAX of about £400. Look at what you have just lost on the "extended pay deal"

That made me chuckle, I recall a very amusing incident where I flew with a Captain who had plenty of "material" of that certain staff member on his laptop, which he insisted on showing me in the cruise. I can only describe my feelings as though I was watching porn with my father - not something I do incidentally.

There are plenty of ladies in the airlines I worked for which were happy to get their kit off, just luck for the hacks at The Sun that they picked up on it!

The thing i find funny about that article is that the young lady in question in the picture is wearing a different name badge, but then to be honest, half of the cabin crew never wear their own name badges. Two reasons; if they loose them they have to buy another, and also if a customer complains, they don't actually have the crew members real name. So they just wear somone else's that they have got hold of somehow.

Anyhow, I thought Edita was based in Dublin not Stansted. The Sun, always No.1 for acurate facts.
