Advice from a lawyer in malaysia
 
Hi masterD,

I've asked a friend's wife who is a lawyer practicing in malaysia. Here's what she said.

Message 1:The small claims tribunal can only handle up to RM25000 and below (peanuts). Your friend will need to engage a lawyer. The first step is to issue a letter of demand (by lawyer) to the school, demanding full refund. If not successful, then need to sue. Lawyer fees cost fromm few hundred for letter of demand, to few thousand for full court case.

I asked what if the school refused to pay after the court order. Reply in Message 2: Then need to take next step where court will issue order to; wind down the school, warrant of arrest; freeze assets...etc. Understand that if school wants to protectreputation, it'll offer to settle with your friend out of court.

Message 3: Just issue letter of demand first and see how the school reacts.

I really hope you get back your hard earned money. Best of luck.

2. Full refund is very hard. :ouch:

It isnt very Uplifting yes but it happens to be the facts, this case is common in alot of countries and its a painful drawn out process to get justice. Sometimes you dont. No point BS'ing about it chap,
Hopefully mine and others advice will help Master D....OK,

Well it's true Major Radzi has left for APFT, but I was flying with him in May/June. Yes, I'm from "that" school.

Been in 17mths and only have 70hrs. :ugh:

Write to the editor of the New Straits Times http://www.nst.com.my they look for stories about foreigners getting ripped off. If they send a reporter to investigate and publish the event, your money will magically be refunded.

Prepare a case with a paperwork trail.
1. Email the school on a daily basis (yes everyday), and cc (copy) your sent emails.
2. Send them registered letters (3 over 9 days).
3. Mail a letter to the UKCAA, Malaysian Consulate, Malaysian Immigration Authorities.
4. HMA is part of the Halim Mazmin group www.halimazmin.com go to their website and send a letter to each director on the board.
5. Prepare your letters with the help of a paralegal, law student or attorney.
Be aggressive, if you are weak or passive, you can kiss your money goodbye.
If you do not get a response in two weeks, than file a case which should include damages for possible loss of a career due to them not returning your money, which could run into millions.
Be Strong, especially if you're considering becoming an airline captain someday.

Master D,

Sue the bastard and don't join the school. You won't be trained to the required standard, and you will be treated second class. Apart from the aircrafts, NOTHING is good.

Better off joining Asia Pacific, who will be using diamond aircrafts which are better-equipped than HMAs. Visited their premises in KB and they are much more organised and coordinated. HMA does NOT have a good reputation amongst students.

Sorry to hear about your case though. Hope you get your money back with interest.
