If he didn't, they can bust him for criminal trespass. But it would be VERY stupid of him, because that's where the "criminal" part comes from. Trespass and criminal trespass may be very different....

I can tell you now before the "investigators" spend millions. The photos were taken on the ground. It's extremely common to allow people to take pictures in the cockpit....
