It's up to the pilot to stay inside of the protected airspace...unless ATC sees the pilot...

Look I will check out...it's obviously too difficult for people on this forum to understand that a pilot, in a real plane, can actually be above a VOR at 10,000ft and need to scrub off some altitude...
