Logging PIC while under instruction

I have completed IR training some time ago and just realised while going through my logbook that I might have logged my time wrongly.
I am asking because while training for the IR I was already rated on the aircraft during that time the instructor only took the control off me to allow me to put the IR hood on and off.

Can someone confirm if time under instruction can be logged as PIC as opposed to dual if you hold the type rating on the machine?

You need an instrument rating and type rating to log PIC under the IFR. If you are training for the instrument rating, by definition you don't yet have an instrument rating and therefore you can't log PIC whilst under the IFR. You log dual time, and the instructor logs PIC.

My view would be that assuming it’s a SP Aircraft you could only log Student PIC on the proviso that the instructor had signed each flight entry as such. But, I doubt that he would do that because although type rated you were not actually able to autonomously operate the flights IFR without his assistance and instruction, regardless of the fact that you were manipulating the controls. I think SPIC flights are meant to cover flights where the instructor effectively acts as an observer and does not actively participate in the flight conduct and management. In the same way that for logging PICUS on a MP type you are supposed to make the command decisions and show command CRM with the actual PIC acting as your P2 - but still the PIC!

Af the end of the day, if you don’t sign the tech log, you’re not the PIC I would say.

But don’t take my word for it - maybe talk to the school/instructor?

EASA - no. All instruction is dual. There can be only one PIC and that's the instructor.

FAA - yes. You can log PIC any time you're manipulating the controls of an aircraft you're rated on, including under instruction.
