No IR within 3 years of exam passes? - rule change?
 

Sorry to keep banging on about this, but no-one I ask seems to know. I understand that are going to change FCL 2.

currently - if you have all ATPL 14 exam credits, a CPL skills test pass but HAVE NOT PASSED AN IR CHECKRIDE within 3 years of your last exam pass, you have to re-take the 7 IR exams before you can do an IR.

if they (JAA/CAA/EASA/MFI) abolish this rule (which looks likely), and you passed your 14 JAA ATPL theory exams and your CPL test over 3 years ago. what does that mean if you dont have an IR and now want to get one?

I would have thought that you could then do training, pass the test and apply for your IR.

Or have I missed the point of your post?

I think so - the JAA IR costs a fortune. Most people want to get an ATPL at some time in the future, and so do the ATPL exams in order to get thier CPL.
Obviously if we could all afford to we'd simply do the training and take the IR test - but most can't. If you dont take the flight test within 3 years of the written, you have to do them again.

If the three year rule changes, I guess it will be here first of all.

If you've gone over the 36 month validity period, I believe you would have to re-take all atpl exams again as there will no longer be the option for IR theory only. That's if the new rules come in.
There will no doubt be an interim period during the change over.

Presently, sit the 7 IR theory exams asap to have another 3 years validity period. If you don't intend to take the IR practical course in near future, why worry and go on about it? Just do the CPL course because why do all atpl exams twice when once will do and the CPL exams will do for now. ??:ugh:

Hi Things have already changed, when you look in JAR FCL 2 see the following;

JAR FCL 2.285 This use to state that CPL(H) & IR(H) = an ATPL(H) theory credit, you will see in the new version of JAR FCL 2 this is not the case. (Version 4 issued August 2006)

JAR FCL 2.050 and appendix 4 to 2.050 gives information of crediting on theoretical knowledge.

JAR FCL 2.495 state the validity periods for theory exams, 2.495(b) applies to CPL and ATPL VFR and 2.495(C) applies to ATPL IR.

LASORS J1.7 makes reference to JAR FCL 2.495 and states if you have not been issued with your CPL(H) and IR(H) within 36 months after passing your ATPL(H) theory you will have to resit all the ATPL(H) exams.

JAR FCL 2.495 as far as I can see does not state that you have to re-sit all the ATPL theory (14 exams) (if no IR was obtained in 3 years) in order to gain an ATPL(H) IR.

Thecontroller seems to be asking whether someone who has currently fallen off the end as far as the 3 year rule is concerned, will be allowed to simply do the IR if and when this period is extended. N'est-ce pas?

yes, thats exactly what i am asking. looking at the FCL PDF it seems like nothing has changed. ie over 3 years and no IR = sit 7 exams again

so ask caa what you require. get it in writing. do the IR and be done with it. This has been done to death I think!
