Hello everyone, I have a question about intellectual property rights.
Let's say I want to build an exact replica of an aircraft which has been out of production for many years and where the manufacturer doesn't even exist anymore, eg. the Miles Magister.
Technical and other considerations aside, would it be legal? Thanks in advance.

Don't see any impediment. Percival Mew Gull G-HEKL is a replica, built by,
DAVID BEALE

Only six built by Percival originally.

However, someone should be the owner of the current Type Certificate for the Type ?

If someone still owns the T.C. then I suppose I should contact them and maybe try to buy it from them or reach some sort of agreement. I guess this might be the case when a company has been merged with another.
But what if the original manufacturer has been liquidated and simply does not exist anymore? Who owns the TC? I guess nobody. The CAA maybe?
That's the way I see it, but since I am no lawyer I could be totally wrong. Opinions, anyone?

First, for whatever Type you are contemplating, I would find out what the certification situation is .. and then go from there. (I am presuming you are looking at TC aircraft).

Without a TC, there is no-one to look after continuing airworthiness.
