BAE Systems Contract - Indemnities???
Hi everyone, well I have received my contract through from Spain, and after having gone for a look round the campus last week, I must say I am thoroughly impressed and cannot wait to get out there. However there is one point on the contract, which I am not to sure of, It states:
I]"The student shall be liable for and shall indemnify flight training against any liability, loss or claim in respect to loss or damage to property or personal injury or death of any person arising out of the provision of the services in this agreement where caused by the wilful misconduct and/or negligent acts or ommissions of the student"[/I]
Does this mean I need to take out an insurance policy to cover myself incase I crash the plane and kill someone or cause some damage???

Killing people and tyre bursts are the least of your worries. The a/c are all insured, can't fly unless they are. Just knuckle down and work hard. Be nice to people, don't be a prick and you'll be fine.

As I read it the "willful misconduct" bit means that if you DELIBERATELY crash into the tower here you are due the bill. Accidents are accidents.
Likewise, if you choose to fly without checking that there is any fuel and then crash, it could also be your fault.
All pretty standard stuff andno worse than a car hire agreement.

As moggie says, the clause is mainly referring to if you deliberately crash or cause problems. Don't, and you'll be fine

Thanks for the replies guys, but having had my Father look over it, he interprets an act of negligence as being, making an error in navigation, or forgetting to lower the undercarriage, select the right fuel tank etc???

Error in Nav - Well, the worst that could really happen is that you're late for dinner. Surely you wouldn't fly into the 5000' mountains would you?
Wheels - You most probably won't fly solo in a Seneca (the only a/c there with retractable u/c), so you would therefore never be pilot-in-command. i.e. your instructor/examiner has ultimate responsibility.
Fuel - Humm......difficult one. Realistically you are not going to go flying solo unless you have loads of fuel. Even if you didn't change tanks, the chances are you would still be OK

Have a look at a car hire or credit card agreement someday - the small print will scare the sh@t out of you.
Try getting a contract from OATS or Cabair and see what they say - my money is on VERY little difference.
