AOCs

Having had a look at the all expenses paid trip the Scilly Isles and the legalities of trial flights threads, I am even more confused!
Can someone help me with the following?
I know that BA has to have an AOC. I know that a charter operator/fractional ownership organsiation such as Netjets has to have an AOC. An FTO does not need an AOC. As a day/VFR PPL with a permit to fly aircraft, I am obviously not talking about myself.
If a CPL holder had an EASA Public Transport CofA aircraft when could he legally take people flying?
Thanks
Stik

Take a look at this pdf

http://www.caa.co.uk/docs/122/summar..._transport.pdf

Now you can find the errors in the other thread :)

Do Netjets have an AOC? AFAIK this is another can of worms. Netjets are registered in Portugal, whose "ANO" permits fractional ownership. One cannot have fractional ownership on a G-reg, AFAIK.
