Rule 5 and balloons
Can any of the Legal brains out there comment on if Rule 5 applies to hot air baloons?

Yes, but subject to the exemption in 5 (3) (d)
(d) Balloons and helicopters over congested areas (i) A balloon shall be exempt from the 1000 feet rule when landing because it is becalmed. |

The latest(?) version of the ANO (dated 30 March 2007) has exemptions moved to Rule 6. Rule 5 (3) (d) is now "The land clear rule". Rule 6. The exemptions from the low flying prohibitions are as follows.... (d) Balloons and helocopters over congested areas (i) A balloon shall be exempt..... Actually, being more serious, this does mean every rule from 6 onwards now has a different number. If anyone is interested I have listed the new rules below. I thought it was a well known fact that the ANO does not apply to Balloon, microlights or glider pilots at all......:rolleyes:
But seriously folks, yes the ANO and Rules of the Air do apply to Balloons just as much as any other flying machine. And does anyone else find it really annoying that the legal bit of the CAA keep changing the numbering system? Everyone knows the low flying rule as Rule 5, so why keep changing it? If they want to 'add' new rules, add them at the end.....:ugh: |
