Just heard back from the airline who insist that the regulations apply to a single flight, with the connection at Dubai falling outside as it is a non-EU state.

Looks like I am going to have to wait for the Court of Appeal verdict.

BTW, there were two of us travelling together.

The court of appeal has now ruled on this and have confirmed that it is the time of arrival which is pertinent and therefore airlines cannot use the excuse that a connecting flight falls outside of EC261.

You can now expect MCT at ME3 airports to increase significantly.

The courts and regulators are very unfamiliar with the law of unforeseen consequences

I'd be very surprised if that happens. The commercial implications of doing so would probably far outweigh the cost of compensating a few passengers.

Compensation for a 400 seat A380 at a 80% load would approach a quarter of a million euros. That is not a ‘few’ passengers.

Current MCT at DBX, for example, is 75 Minutes. I wouldn’t want a connection that tight, unless I was hoping for compensation.

Remind me why the people voted for Brexit, when this is a perfect example of how the EU benefits it citizens.

I am not sure the passports will be printed in France. The company that won the contract has an operation just up the road form me where they currently print UK driving licences.

It actually gets a little more complicated with Brexit:

The Parliament has rewritten Regulation 261/2004, however the Council will not consider it due to a dispute (UK-ES) about Gibraltar.

On 31 March 2019 the UK leaves the Council (and the Commission and Parliament). The following day(s) the Council adopts the rewritten Regulation the ES way and it automatically applies to the UK (implementation agreement requires this).

Hoisted by their own petard. (Sorry to use a French word)

I have an outstanding claim against Emirates for this exact situation for a flight leaving out of Amsterdam; 24 hour delay in reaching destination due to missed connection.

Does anyone have any advice as to how to pursue this through NL regulations? I am British. I assume I can't use the UK small claims court as it was a flight from AMS?

A couple of years ago I was 12 hours late at my destination due to a missed connection at Dubai on Emirates. EK paid for B&B so I got a few hours sleep between flights and I got a full night of sleep at my destination instead of having to go to the office straight off the flight, so I consider it worked in my (but not necessarily my employers) favour. It never occurred to me that I might be entitled to compensation beyond the hotel and transfers EK provided in Dubai.

First try and claim directly with Emirates. National Enforcement Bodies only get involved when airlines refuse a claim. If your claim has already been refused then reopen it. If your claim is valid they should new settle. If they demure contact the Dutch NEB.

I'm pleased to report that I have now received compensation for the missed connection, though I had to be persistent and maybe a threat to involve the CAA helped.

If anyone has been refused in the past and feel that their claim is valid, I recommend having another go.

When Emirates A380 BHX-DBX-SYD went tech at BHX, there was an 8hr delay before another was cycled in, from LHR I believe. By time we made DBX the connection had long gone and we waited 5hrs for the DBX-SYD-AKL. A 23hr set of flights took 35 to destination. We claimed under EU261/2004 and got the full delay compensation - but not a word of apology.
And as an aside, when in DBX and trying a)to find our sleepy way round the airport which is as big as some countries (lol) and b) simply trying to find out what was happening, I have never come across Staff as rude, uncaring and brusque as Emirates transfer guys. Utterly dreadful!
