Hilarious. Taxpayer money hard at work! Meanwhile the 'fare paying public' (meant to be the main focus of CASA's core activities??) which are numbering into their thousands travelling on a daily basis are left to the devices of larger operators who are being publicly named and shamed on an almost weekly basis for acting in a non safe manner are not getting a gournsey due to CASA resources (no doubt some crusty old GA FOI has-been who is counting the days til retirement and a nice fat super payout) pounding the red soil of Roma!!

Remember that you dont have to hand over anything that may be detrimental to yourself.
ie.. yr log book ...because ten pages back you havent completely filled in all the lines.
You are NOT obliged to incriminate yourself.

As far as I am away, it has happened in court that a CASA demand under 5:56
has fallen over on that basis.

Its a bit like yr right to remain silent. But of course our esteemed regulator just sees that as a black mark against you. :eek:

When you know their case has no merit/is false but "Some people in Canberra think they can make this stick"... why would you want to talk with the fcukers!

CASA do not think I am a fit and proper person to hold a commercial pilots license. Ironically Motorcycling Queensland think that I am such a fit and proper person they have awarded me Queensland Official of the Year because of my safety conscious approach towards Motorcycling. :D

John, good point. I am an accredited member of CAMS. They have rigorous high standards and a 'bench mark' and 'entry level standard' that make Fort Fumble look like the two-bit outfit it is. Plus the risks in motorsport in general are higher than flying an R22 around a rice paddock.

'Fit and proper person' and section 28 of the act are CASA's 'get out of jail free cards'. They dont have to nail you with anything specific, they just put together a trail of weak ****e and attach 'don't think you are a fit and proper person' to it and you are toast. Under the current system this is legal and an accepted practise.
Hypothetically, its like getting pulled over on the road, lets say in your case John on a high powered Ducati. The copper hates Ducati's, he is a Honda freak, so the entire charade is a farce simply designed to nail you for riding a bike the copper does not like. Although you weren't speeding Constable Plod simply hates Ducati's, so Constable Plod, and his offsider, let's say Senior Constable Koontz (always two on one, another CASA tactic) decide to book you for doing 113 km/h in an 80 km/h zone. They make sure you are in an area where there are of course no camera's or anything else that could work against their 'claim' that you were speeding, and the subsequent fine. Now, let that run its course and wind up before a court and see what the outcome is. The Beak will side with Constables Plod and Koontz almost every single time, it is the nature of the tainted beast.

We live in a part of the world governed by a corrupt and stacked Westminster system.

I have asked casa under the foi act for my entire case,I bet I do not get all of it.because then we will see the truth and extent that they went to.

Did you look at seeking a review of the AAT decision or an appeal? If it goes to the Federal Court you can subpoena the documents but of course you face further risks as to costs if it goes against you.

Perhaps you should also be briefing the Commonwealth Ombudsman at this point as well?

Quite a stalemate the DAS has on his plate, if he goes the distance. (Dubious). Aye well, it's all idle speculation (at the moment), but I hear it's all downhill for the star chamber, Micro Manage Master Team (MMM-Comic enterprises): seems as though "team" got it wrong; once again.

Anyway, and just thinking out aloud here; IF it was ever proven (beyond reasonable doubt et al) that JQ was not flying "that" sequence: then who was????
