a question for you. When are you and your cohorts going to have the courage of your convictions and step out from behind your "Judge Judy court" and prosecute these alleged criminals in a "Real Court", if you are so convinced they are guilty, and not just "stitched up"?. I'm not one way or the other, just concerned that "justice" is done and seen to be done, the AAT is not justice. The regulators are the one's that criminalized our industry, yet would rather use tactics akin to the Burma regime rather than face a real court. Maybe the BK ex RAAF baggage handler might have some problems in front of a proper judge? |

After all, the only reason my cohorts and I take regulatory action is to hurt licence and certificate holders. We enjoy inflicting unnecessary pain. Majorrazor you are either CASA or are so out of touch with the industry , as you have no idea of what you are talking about. John Maitland Lawyers of Melbourne has made a virtual fortune out of having to stand up for those that cant defend themselves , due to the stance of CASA. CASA at present should delete the word safety from everything pertaining to their operation, as they have nothing to do with safety at all and in the words of their self serving leader "CASA is about regulating and that is what CASA will do"

If the regulator reads this, and has an interest, I have been given, via this forum, important information which I feel obliged to share with you as a seriously concerned citizen.
It is of an operator who regularly carries out criminal and illegal activities, illegal maintenance, displays incompetence on a grand scale, has crashed, or written off, just about every aircraft it has owned or operated over the years, has an abysmal workplace health and safety record with it's employees. They have terrible money management skills and an out of control discretionary fund. They write their own rules as they go and I have information from within it's ranks of bastardization and cronyism. The outfit operates a monopoly and regularly runs people out of business. They are still very much in business and have obviously escaped your obligations as "the expert" on aviation safety and surveillance in Australia which I understand includes a duty of care to any individual taxpayer who expects your vigilance. PM me for vital information concerning this miscreant before someone dies as a result of you simply not being aware. |

You could certainly be forgiven for thinking it was in Indonesia, but I regret to inform you this operator is right here in Australia. The only thing that prevents more accidents of recent is they have drastically reduced their flying hours. I guess like any operator, if they don't fly they will eventually achieve a perfect flying record.

Question: Why does the ATSB not investigate all "prangs" - the link with pilot errors, CASA, safety culture, maintenance, aircraft type would be interesting. Also, what about the insurer and owner in this - this combination would have an interesting impact on the "accident" rate. |
Would this operator have operations based in a few major cities in Oz but deploy to most airports in Oz on a regular or semi regular basis, and have a reasonably high management overhead? If so I can guess who it is, they should know better, they've been in the game a very long time..
I'll come back tomorrow with my guess, unless someone beats me to it. |

Is only CASA guilty?
We all love to kick CASA. No, they don't make some operators' lifes easy but should they? They are supposed to assure aviation safety which could include putting those who don't play the game out of business (withdraw the AoC). Sorry, CASA is regulating you not asking you.
How often did I see aircraft instruments being repaired by the CFI to save money. How many pilots were forced yo exceed the flight time limitations? Come on, he operators are not angels and those who usually cry foul loudest are the biggest culprits. Look how many went out of business last year! Yes, I know, they wanted to cash in on the Indian market nor realizing Indians pay only low rates if they pay at all. The shortage of money forces people to make a choice: Make shortcuts or close the business. Life is tough. Dear operators, do the right thing according to CAO, CAR CASR and AIP. Don't make sortcuts and you will be ok. If you can't because the Dollar pinches then please close your business. Nobody has the right to make a living by creating a risk to others, The industry has shown it must be regulated (not self regulated). Aviation regulation is not a democratic club. Operators don't determine but do what they are told. That keeps members of the public safe which is more important than the feeling of one or two operators. |
