Flying Pay/Pension - Legal Rep
 

Dear All,

The flying pay/pension issue raises its head again.

Does anyone know the name/address of the legal people used by the group of RAF chaps who took MOD to court?

I'm interested to find out if the goal posts have moved at all, or how successful/unsuccessful they really were.

The solicitor's firm we used was Townsend's in Swindon, but our representative's wife inherited a farm in Ireland and he has 'retired'. I don't know who has control of the papers in the case, or even if they've been retained. In any event, although I was the client, I cannot pass on the information without the consent of the contributors since, as far as I'm concerned, those who contributed at the time paid money in good faith and would not be happy if I were to give away what is essentially their asset.

Counsel were Anthony Peto, he had experience of 'class actions' including pensions type cases, and Dinah Perkins who remains a leading judicial review advocate. Counsel do not retain paperwork and in any event would not be allowed to share information from one client with another client.

Interested parties should recall that we spent £10,000 in administration, solicitor's fees and obtaining counsel's opinion. This doesn't allow for the fact that I gave probably hundreds of hours for free as I co-ordinated over 300 contributors, produced newsletters, attended meetings and carried out preliminary research.

Whilst it is always worth revisiting issues, unless you definitely know of a specific change either in MoD policy or the laws of the various systems under which each of us live - England & Wales, Scotland, NI or the European Union - then in theory the result should be the same.

Sorry but I have to know now that the thread has started!!!!!

I'm guessing that the case didn't finish in the contributor's favour. I know some of those who contributed and they didn't appear to get any special supplementary pay statements or buy new sports cars!:(

Spoke to my missus about this topic, she has dealings with tax etc, and she says that it is all perfectly legal. You can have a taxable allowance that is non-pensionable. All perfectly legal and above board. - Sorry.
