At the Federal level, still illegal, controlled substance. While I don't care what the Land of Fruits and Nuts do. (its legal in my state, too); legalizing will make it hard to maintain a drug-free status in safety critical industries. Already, the cry in aviation here is, "it's legal, why can't I partake in weed as a pilot?" Thus could end badly, look up the name Ricky Gates at AMTRAK.

Booze is legal, doesn't mean that pilots are sanctioned to fly bent now does it?, same applies to Marijuana use obviously

No, because it is still illegal at the Federal level, so while legal for a California resident, is not if they wish go hold a FAA Airman's Certificate and Medical.

The FAA Medical application will ask about controlled substance abuse/use and, being a Federal document admitting to marijuana use will be asking for deferral and denial at OKC.

Not sure the legality argument has ever stacked up for marijuana use. It's illegal here, but is generally pretty much ignored by the police unless they either suspect someone of driving under the influence or they find someone with more than would be considered to be for personal use (in other words a possible dealer). The majority of people here can walk around with small quantities of the stuff and are very unlikely to find themselves in trouble if the police find it.

A friend (now passed away) used to use it frequently, for relief from the symptoms of MS. Her son would buy it and said it was dead easy to get hold of with virtually no risk of getting caught. He did once get caught just after buying some, explained it was for his mother and the police just let him go, with no further action. To all intents and purposes it might just as well be legal here, as the police only seem to expend effort on those growing the stuff or dealing it, not those just using it.

I don't buy the argument about flying under the influence; it's no different to the old "8 hours between bottle and throttle" rule (which is now out of date, anyway, it should probably be double that to be safe).
