Statutory Holiday Pay
 
Does anyone have any information from the HKAOA about an update with regards to the SHP claim?

Many of us submitted paperwork years ago. Will anything ever come of it and is there a case for back pay for the many of us who have left, either through resignation or retirement?

I have emailed the GenSec and had no response.

A number of us have written to the GS and GC with no response let alone an explanation. RF had promised an explanation on the Forums which never materialised.

Easy fix. Negotiations on any matter will not be entered into until the company complies with HKG law and pays Stat Holiday Pay with interest. The company was breaking the law (yet again), they owe some employees money. Pay up.

There’s around 300,000 USD a month coming into the institution from 2000 pilots. That’s why.

Holiday Pay Claim
 
The company I work for currently has around 250 Pilot's that are registered to make both a holiday pay and pension contribution claim. The group claim is from 1994 to current day and interest will be applied at the recommended rate. The criteria for claiming is that you were / are classed as self employed and operated through a recruitment company or direct to the airline. It is easy to register, free of charge and fees are only deducted from successful claims. Pilot claims are proving to be of extremely high value, the average is currently well in excess of £150k per case.

Plainpilot11 you make a good case. I am no longer employed by CX and no longer a member but if your monthly dues are around HKD1200 a month your figure is correct.

I appreciate your reply but the information relating to Holiday Pay was taken uo on behalf of Employee's where our group action is only for the Self Employed. We can also only represent those that operated through either a UK based recruitment company or direct to an airline and personally residing within the EU. I have just tried to upload the case notes of a successful claim by a Ryanair Pilot but for some reason it will not allow me to do so? Please google the case for; Jason Lutz v Ryanair but there are of other examples where our claim is based upon.

King v Sash Windows
Smith v Pimlico Plumbers
Uber drivers v Uber

Our claim is Free to register and can date back to 1994 and is 100% based upon a No Win, No Fee basis - Claimants really have nothing to lose - Registration is easy and you simply upload copies of payslips, contracts and proof of residency etc. There is a deadline for this type of claim of December 2023 and there will be no further actions of this kind beyond date.

Claims have extremely high values as in the Smith v Pimlico Plumbers case where he was awarded £74k. So far, Pilots are seeing claim values up around £150k and more, it depends on time served and gross income per annum.

Once the company offered ERS in 2020, he ran off into exile home to NZ leaving behind the biggest industrial mess in decades.
