3 Hours 16 mins discretion?
 
Allegedly, a KA 320 returning to hk on a red eye flt, exceeded the " only in emergency " discretion limit by 16mins . The crew had already diverted to ICH due unruly pax. They then operated to Busan and then back to hk.
3 sectors completed. Departure time was around 3am for the outbound from hk.

Anecdotal evidence suggests the flight was suppose to land in TPE for crew change and indeed a crew were waiting there .

However , the crew decided to continue to hk against the pre arranged landing at tpe with IOC.

Nothing heard since from L2.
Captain is spouse of KA management.
Expect no further update. Issue closed . Crew did excellent job and the captain will be commended .

You can look up 318 outbound too. Approach to PUS discontinued at 10k ft, said to be due tailwind and vis not good enough for the circle, goes to ICN. Report time is 0125am local, you can work it out yourself but it is well over 3hrs FTL exceedance for three sectors. I can't think of an emergency that justifies passing TPE. It will be interesting to see what, if any, action the CAD will take.

Some Facts that might make interesting reading: 1) First Officer use to be a senior captain but was demoted to rank of FO after levelling off at 100' some1500m from the threshold !
Well documented case . Hes very keen to do the right thing in managements eyes to return to the LHS.
2) The Captain is very keen to do the right thing possibly due peer pressure from her high ranking spouse in training management .

Possibly together , this makes a blinkered go minded team , come hell or hogh water .

Recollect once, inbound HK following two sectors and long delays, we were told to land enroute for crew change. I had calculated that we were not going to exceed 3 hrs discretion but, following an hour arguing with ops, I said "Soddit!" and routed across Burma at an intermediate level, unable to contact any ATC unit, to land and crewchange.

I DID once go over three hours and the snottogram my boss received from the CAA made it clear that there would be 'consequences' if it happened again.

So, a long day, long delays, the company is saying stop and rest, and you're arguing for more? WTF???
It was more of a hassle and more dangerous to divert and pick up the relief crew. We were going to be perfectly legal.


I presume you exceeded MAXIMUM FTL's because it was an emergency.
No, but further delays on the last sector put us about ten minutes over.

You can't exceed the 3 hrs unless it's an emergency and the safety of the aircraft and occupants may be compromised. So if you're over 3 hrs it's because it's an emergency so you tell atc it's an emergency and you don't have any delays. So if you weren't telling atc you had an emergency you shouldn't have been still flying. It's that simple. The fact that you had delays and went over 3 hrs without an emergency is an eye opener.

Another reason I'd rather not merge with KA.
