Why there will be no Contract Compliance
 
Been there (that united thing), when needed, the membership ran. We won. I guess they had more to lose (Most are still around, so don’t expect help from them). Most are on a good package (and some are, just ask your FOP Managers), compared to what they will get anywhere else in the world or the one on B minus minus minus minus minus…………..(the last several minuses are for future COS changes). You still have a good deal and only a few will leave (may see some of the angry ones leave) The Cathay Pacific Group. Young kids just want to fly shiny jets and don’t care about COS changes, pollution, reduced medical or reduced pay.

Not too many with that Provident Fund, Medical, Travel Fund, etc will fight for a local housing, S/O housing or seniority, new joiner COS changes etc. It’s not their fight but they are the first to complain they have not received a payrise since…….. forever. Can’t even defend their contract, we win yet again.

At most you may get passive resistance. The ones that agree with removing their goodwill are already doing so. We can manage nicely because there are not too many (we have there names). It is a vocal minority. We know this and your AOA leadership knows this, which is why he vetoed Contract Compliance. We have also told the AOA Leadership that if it gets out of hand once again, we will be pressed to protect our operation. You know what that means, short term pain for long term gain (contract terminations). It will take as little as 5 pilots to be terminated to bring the rest inline. Yes we will put them through a D&G, but we run the D&G. Even the appeals, we win yet again. Don’t like it, take us to court.

If the AOA voted in CC, the ones doing it will continue and the ones not doing it will not. You think a Senior Capt will give up 10-20 hours of overtime on the hope of getting a payrise? That is his payrise. He is happy with that payrise and he still has all the benefits. He will not put that in jeopardy.

You believe new Captains (joined at age 23) age 35ish flying a wide body jet are going to put their head above the parapet for some S/O that is getting shafted or Senior F/O’s having their commands postponed due to 65? I think not.

No one will challenge The Cathay Pacific Group; they know what we are capable of.

We have people joining training in droves. At the probation interview, they are told they are one of the best pilots and the command course went great. At the end comes the sales pitch “You would make a Great Trainer” and when you become STC, you will receive 20% to your PF and your training allowance is PF’d. Gullible and short memories, but hey, better than Emirates, etc. It’s all about them. We have been doing this for years and it works. Pilots have egos, some are bigger than others but all have egos. We have never had a problem recruiting or maintaining trainers in Cathay. It is well paid and respected position.

You see, you cannot win, we have every avenue covered, including the Court System, Judges and the Internal Revenue Department (just ask the AOA on their recent housing challenge).

Resistance is futile. You will have to accept what we are willing to give you.


It’s over. Your AOA is finished. Do you think if you elect some militant President that things will change? Remember you still have the same membership and most will not follow. You may as well save your money and invest it for your retirement or that new toy you always wanted. We do what we want.

Enjoy your 13th month (most likely to pay your increased tax liability) and for the ones that don’t receive it, thank you for going above and beyond the call of duty. My bonus thanks you.

Due to higher fuel prices, the downturn in the US economy, reduced fuel surcharge, etc don’t expect much in the way of profit sharing. We need it for the future and my bonus of course.

Our buddy, Management, forgot to mention the Croft's case in the UK. What was the penalty, 42 million? Say again about the courts.
Wrongful dismisal lawyers are wringing their hands in the base areas, let alone prospective union representation.

Still many cringe at the thought of CC, they can’t figure it out.:{:(:=

I still think many are scared of management. That is why we have so many using discretion, joining training, working G days and being helpful.:ugh:

How many times do you have to get punched in the face to know that the bully will always punch you in the face when you walk by? How much is enough? Some here have a high tolerance, but I guess it depends on which package you are on. They are just hoping to maintain that package.:ugh::rolleyes:

Management is on the same package, that is why they don’t attack it directly(not lately anyway), so now they go after new joiners.

Anyway back to the topic, pilots are fearful. Full stop. Until that changes, our conditions will continue to deteriorate.:*

I hope you aren’t saying CC and MSS are the same thing? CC is simply following your contract to the letter of the law. Nothing more, nothing less. MSS on the other hand were some on the AOA GC’s slanted view of what was in our contract. Lets not go down that road again.

All sounds simple..... however a few examples...

1. Report time is 70 mins before push. Are you going to arrive smack on time and read every word in the docs before deciding the fuel? Not prepared to do that...are you going to think ill of someone that does that?

2. Big tech delay out of HKG... As a crew you decide your departure time with no discretion.... the time arrives and L2 is still open. Do you call IOC and say "game over" or do you start reworking the figures... quick taxi here, CI250 there.... As an FO or SO do you say to the Capt... "No... we are at the agreed time and I don't care what shortcuts you think you may get..."

3. Big delay out of LAX. 15 hour sector and it's tight to get back to HK without discretion following a slow baggage load. Crew Control say launch and then look at your crew duty and declare HK or TPE. You get airborne and IOC acars and say no crews are available to position to TPE; with 30 mins discretion you can make HK... the Capt says lets do the 30 mins and he can be in bed with his loved one by 8am and home by 10am:} The girls all have flights to MNL; you're the SO or FO... what do you do....?

4. The hotel calls you for the 883 when you are on 881 (about 2 hours early) you were asleep and you don't get back to sleep. It's a 15 hour flight; Do you claim disturbed rest and call CC and tell them to get a fresh FO...?

By all means; don't answer your phone on G-days....that requires you to do nothing... no head above the parapet. However, the examples above have all happened to me and require an action.... your neck is very much on the block.

For those of you banging the drum for AOA backed CC. Read thru the scenarios above and how difficult does it become if your actions (inactions) will cause you to be blackballed by your union....???

First of all, grow a spine.

1. Get there early and read the required paperwork. No one looks down on you for that one.
2. Yes you take into account CI 250, short taxi, etc. You do what YOU can. When you hit that time, it’s over. Read the first line.
3. No crew, not your problem. Land in TPE. Get your required rest and then go back to work. Read the first line.
4. Not adequately rested. See the HK ANO’s, it your responsibility. Submit an MOR. Read the first line.
What happens when you don’t have enough fuel to make Hong Kong and there is no crew in TPE, continue to Hong Kong?

Good luck with that payrise. Sometimes it has to be short term pain for long term gain, but it’s all about me.

Most Captains don’t have the backbone and the F/O or S/O should not have to stick his head up. You’re the Captain, make the call.

So if the F/O or S/O does not want to go, you most likely would say to crew control “Yes I would like to continue but it’s the F/O’s or S/O will not do it”. Make the junior officers pay. You just say “I am not using discretion”. They can ask you why and the answer should be “I don’t get good rest on the aircraft and I’m fatigued”.

How MSS was presented to the AOA Members was flawed.

MSS should have been presented as “opportunity”. If you have an opportunity, you take it. MSS or contract compliance (call it what you will, it’s the same thing) has many opportunities

For example, if you ask an engineer about a problem with the aircraft and he says it is fine verbally, then ask him to write it in the Maintenance Log. If it is fine, there is not a problem. If he doesn’t, now there seems to be a problem. Why? Maybe he doesn’t want to take the delay by fixing it. By putting it in the Maintenance Log you are covering you’re a$$. That’s opportunity.

If you are presented with making a decision about discretion, that’s opportunity as with reduction of rest, flying on G days, or anything Liam said, etc. Read the first line.

What does MSS mean to you?

The AFTL's are part of your contract, work to it, No More, no less.

You appear to have not understood Point 1; for someone who appears so determined to work to the letter of the contract and be quote "unhelpful", why do you advocate pitching up before report time (its not like I'm getting paid for it!). If I was on your crew and showed up exactly on report time and then proceeded to read all the docs, would you think of me as hero or zero??

Like I said Bloggs, in my limited time at CX I have experienced the scenarios outined and, save for a couple of weeks in 99 and 01, have never seen a crew member play hardball with the company. Whilst guys are conservative with fuel, the availability of crews and the desires of other crew members do affect the way the options are played out in AFTL's and Rest requirements; to suggest otherwise is fatuous. I have heard a lot, particularly in 01, talk it up large, but their actions said otherwise.

I shall be interested to read the response of others.

Liam, if you would like to pitch up early or not, it’s your call. It doesn’t have any effect. I pitch up early and work out my Flight Duty Period and in particular, when it ends.:ok:

The AFTL’s are for fatigue purposes only, availability of crews and the desires of other crew members should not be considered in your decision. If it does,you are just looking for an excuse to justify your actions or inaction's as it may be.:rolleyes:

You don’t have to use discretion but many do as they are scared of the big bad wolf.:{:=

Yes I agree, lots talk but many are just plain scared and intimidated.:sad:

The company cynically reduces the Report time because it makes some of the tight duties even tighter; your response... show up early... be ready... OTP..rah rah rah....

You get a delay; crew duty gets tight; so you quote "take into account CI 250, short taxi, etc. You do what YOU can" Whats wrong with max FDP less CFP plus a conservative taxi allowance at each end.... No lets do "what we can"... OTP... rah rah rah

You get airborne on a delay and can make it home with 30 mins discretion. Nahh...lets pitch into TPE and screw up the lives of the people who have been preparing your food for past 14 hours.... what a guy....:rolleyes:

Frankly Bloggs, save for sitting at home on a g-day with your phone off, which you are perfectedly entitled to do... you are the model employee!!

Primarily, I have to justify my actions to myself......

I tend to live by a series of simple rules; one of them being.. "Never p!ss off people who prepare your food.."

If you or anyone else want to get serious about Contract Compliance; read some of NC's recent posts. His posts make sense; your posts however vent a lot of hot air...... I hear it all the time on the Flight Deck; but I am acutely aware that same guy pitches up to work nice and early; aches over the fuel decision and proudly beavers away getting directs and advantageous levels...
