90 day rule

Hi.

Question: does the three take off and landing in 90 days (schedule 8) rule apply to instructors as their "student" is not a "passenger" ?

I don't believe it does... unless you have a "passenger" in the back seat.

Wish I could quote something to back this up, but I'm afraid I can't.

The rule applies to every one if carrying passengers but a student is a crew member not a passenger. Article 155 definitions

‘Crew’ means a member of the flight crew, a person carried on the flight deck who is appointed by the operator of the aircraft to give or to supervise the training, experience, practice and periodical tests required in respect of the flight crew under article 42(3) or a member of the cabin crew;

‘Passenger’ means a person other than a member of the crew;

Great. Thanks for the replies. I had a feeling in my waters that was the case but was not sure.
