Instructing on a private aircraft
 
Good Morning

I have a quick question.

I am a qualified FI, no restrictions and I’ve been asked by a CPL holder with just a MEP to do help him achieve his SEP.

This would involve him hiring a aircraft and having me fly with with for some Dual to get him up to standard and then the relevant exam.

The question is behind the legality of it. Does the aircraft need to be registered to an ATO? Do I need special insurance? Can I do it.

Any help and advice would be appreciated.

Training for a class or type rating must be conducted by an ATO that has an approved SEP course or a DTO that has declared a training programme for such a course, it cannot be done by an independent FI in the manner that you suggest.

FCL.725 Requirements for the issue of class and type ratings
(a) Training course. An applicant for a class or type rating shall complete a training course at an ATO. An applicant for a non-high-performance single-engine piston class rating, a TMG class rating or a single-engine type rating for helicopters referred to in point DTO.GEN.110(a)(2)(c) of Annex VIII (Part-DTO) may complete the training course at a DTO. The type rating training course shall include the mandatory training elements for the relevant type as defined in the operational suitability data established in accordance with Annex I (Part-21) to Commission Regulation (EU) No 748/2012.

(b) Theoretical knowledge examination. The applicant for a class or type rating shall pass a theoretical knowledge examination organised by the ATO to demonstrate the level of theoretical knowledge required for the safe operation of the applicable aircraft class or type.

The person In question has completed a integrated course with SEP hours in their logbook.

This would simply a SEP Famil flight before a flight test.

Would this make any difference?

It wouldn’t count officially as you’re not part of the ATO structure and the assessment of training required and then carried out should match so there’s “no way” out of that.

Any flying done prior to that would just be “knocking the rust off” to hopefully reduce the assessment.

The person In question has completed a integrated course with SEP hours in their logbook.
The important bit is was that a traditional Integrated course which includes solo time or an MPL Course which does not. In the latter the candidate will have to make up the differences, but all at an ATO or DTO as stated.
