Cobham Is At It Again (Merged)
In addition to the press release below, story around the traps is that a pilot has taken written evidence to the Workplace Ombudsman indicating threats due to his negative comments regarding the proposed AWA. Threats are credited to a flight ops manager.
Some thing like "whilst arranging a hit-man might do the job, I think we should look at other options first".
Is this considered duress?

Workplace Ombudsman In Perth Today As The Workplace Watchdog’s Prosecution Of Major Transport Operator National Jet Systems Resumes
Australia’s Workplace Ombudsman today resumed its prosecution in Perth Federal Magistrate’s Court of major transport company National Jet Systems Pty Ltd over grave allegations it applied duress to two of its pilots to sign Australian Workplace Agreements (AWAs) and underpaid 33 pilots.
Nicholas Wilson, Australia’s Workplace Ombudsman is in Perth today as part of a tour of metropolitan and regional Australia said “the community has a justifiable expectation that workers’ rights will be respected by their bosses; that they will not be subject to undue pressure to sign AWAs and that their bosses will pay them their lawful wages and entitlements.”
National Jet Systems Pty Ltd provide contract aviation services including air charter flights and maintenance services to the Australian Government as well as other organisations including Qantas for whom it supplies pilots, cabin crews and aircraft for Qantaslink flights around Australia.
National Jet Systems have an application before the Federal Magistrate’s Court seeking leave of the court to allow them to ‘join’ two of the pilots to the legal action.
“What this case shows is that anyone in the community can have their workplace rights and entitlements brought into question and that the Workplace Ombudsman is unremitting in our efforts to protect the workplace rights of all Australian workers,” Mr Wilson said.
“We recognise that most employers meet their legal obligations to their workers. However, the Workplace Ombudsman will relentlessly and untiringly pursue bosses who do not comply with workplace law by not paying their workers the wages they are entitled to or seek to contravene their workers’ rights in other ways such as applying duress to sign AWAs.”
Today’s court action also illustrates the workplace watchdog’s determination to inexorably prosecute employers who allegedly contravene workplace law. The Workplace Ombudsman’s initial court proceedings against National Jet Systems were initiated on behalf of three National Jet Systems pilots in May 2007 and was subsequently widened to include 33 pilots in June 2007.

TWU’s patience runs
out with National Jet
out with National Jet
Dear Member
National Jet Systems management has failed to respond to a TWU proposal that they begin negotiations with the union on a collective agreement to cover their pilots.
The proposal was put to the airlines WA Human Resource manager, Mary Kinsella (WA) and John Crawford from the airlines national office on July 12.
We outlined a range of members’ grievances and told the company we were speaking on behalf of over 100 NJS pilots who are now union members. We explained that the existing mish-mash of working conditions was creating widespread dissatisfaction and disturbing morale problems among their employees.
The NJS managers recognised our right to act as bargaining agents and indicated they would get back to us WITHING SEVEN DAYS after they had put our proposal to their top brass in Adelaide.
Since then we haven’t been paid the simple courtesy of a phone call and none of our calls or emails to them have been returned. We call that rudeness.
This has left us with no alternative other to step up our campaign for a fair deal for NJS pilots. It’s time to kick start the Jumbo.
Our Industrial & Legal Team has been asked to prepare the required paperwork needed to initiate protected industrial action. Pilots will be fully consulted before such action is taken and secret ballots will be part of the process.
Meetings of pilots are being planned for Perth, Darwin and Cairns. The logistics involved in getting as many pilots together are a bit complex but as soon as we know exact dates you will be notified.
The TWU firmly believes it is time to stop pussy footing around. Thecompany is not responding to sincere attempts by pilots and their union to sort out the airlines industrial relations shambles.
We call on all NJS members to seek the support of their fellow pilots in bringing this long drawn out saga to a conclusion. Your input, which we value greatly, can be channelled through Rick Burton 0417 914 108.
Or you can email Rick at: [email protected]
Yours in Unity
Jim McGiveron
State Secretary

Much Ado............
What you say is sensible. However, there's absolutely nothing that's been 'aired' on this thread that the company wouldn't have been well and truly aware of since July 12th when the TWU put its proposal for negotiations to commence for a collective agreement with the pilots.
July 12th would have been the technical notification date of the 'bargaining period'. As such, it was the point where (basically) the gloves came off. Sure, workers are theoretically protected from intimidation and harrassment by a company in cases like this. But workers aren't protected from all the dirty tactics and bastardry that management will adopt to try to stop workers taking action.
And those dirty tactics and bastardry would have been devised by the company well before July 12th.

Good stuff, the TWU has some teeth ( we all knew that ) and are actually showing them, they still need backing by the members however. If the tack is to, for example, not work on days off, or maybe not accept upgrades for lower conditions, it will be interesting to see how many will stick to it.....this time.
Will watch this with extreme interest.

How about the training pilots showing their true worth.
Multiple resignations from training pilots (only fromn their training positions) will slow things down considerably.
Put your ego's in the cupboard for a week or two.

The beauty of this situation is the good working relationship between the the Unions, noting most miners are members of their own Union.
I think when:
and,
Makes it's way onto a letter, consideration is the alternative to what is probably going to happen.
Action could be on the cards in a very real form, protected industrial action, are not the words of the mis-informed.

QantasLink pilots to take industrial action

Pilots who fly for QantasLink have voted to take industrial action against their employer National Jet.
They voted to take action in support of their bid for a collective agreement to replace their individual contracts.
Rick Burton from the Transport Workers Union says the pilots are being forced by the company to accept lower pay.
He says the pilots will decide what action they will take in the next fortnight.
"We will be making an application that will allow us to take anything from four hour stoppages to eight hour stoppages," he said.
"We're going to go for the most effective way to make this company come and have negotiations with the TWU".
National Jet has issued a statement saying it does not expect its business to be affected.

So, cunning, we can take that as a ringing endorsement for remedial treatment and heaps of "depends" for your unfortunate inflictment ??
That aside best of luck to those involved - as an outsider seems a situation that has been brewing for a long time and whose time may have finally come.
Now a question to clarify - who was the FIRST major(?) operator to charge for endorsements??
I have stated before my dismay that VB took up the cause with so much vigour however I am aware they did not start the rot.
Was it Impulse - NJC - another operator??
Thanks in advance and once again best of luck to the NJC personnel.
