ANSP vs regulator
 
Somehow I recall that functions of ANSP and a aviation regulator (aviation authorities?) should not be mixed, i.e. one cannot be a service provider and an aviation authority in one. I found a document by CANSO stating that in a very general way, does anyone happen to know any legal source of such separation?

In Europe try article 4 of the framework regulation (549/2004) - I think this has been amended slightly in more recent legislation, maybe 1070/2009 but I don't have it handy to check. Similar, but less specific philosophy in ICAO as I recall.

Maastricht ACC, an ANSP provided by Eurocontrol.

Eurocontrol, an organisation which supports 4 countries in the Regulatory oversight of the Maastricht ACC, and also provides Regulatory duties in support of the European Commission to provide SES legislative frameworks, Rule Making, Safety, and Environmental legislation.

Not saying there is a problem with the arrangments, but there is a dual role in the organisation.

Ahhh, not the answer I was expecting. I think you'll find that the NSA's of the four involved States took over supervision of MUAC some time ago.

Now if you consider the CFMU (or Network Manager as it now likes to be called) to be a service.....that would be a different matter.
