To steer clear of hijacking the current MACC thread, I find this comment a little interesting.........

Care to expand? Legally not enforcable? Says who and how?

Your contract with NATS states it is a MOBILE GRADE. You agree to that contract on joining.

You can't pick and choose what bits of a contract you like.

It's the "legal involvement" that is mentioned (4 different legal teams???) that has really got me scratching my head. It's mentioned they are "persuing" it at the moment.........to me that doesn't sound even remotely like fact.

Would be interesting to get a union view. One would have thought if it was being persued by so many legal types the union must have had an input.

Reading my post above, I think I may have been a bit blunt.

Yes, if you are based at Manchester and are told to move to scotland, it is an upheaval (in the same way that us TC guys are suffering an upheaval next year); but I stand by my point that we signed up as a mobile grade.

The fact that you are usually very immobile once valid is a bonus, not a right!!

It is made absolutely clear when you first approach NATS that it is a mobile grade. Indeed, I remember it being a fairly important question during the interviews.
Anybody in NATS that didn't understand that on signing up is in the wrong organisation. :rolleyes:

I think some of you guys may be missing the point of the question.

Sure, we all signed up to be a mobile grade, but then the older members also signed up into the Civil Service, a smoking environment, etc, etc. It appears that the legal situation MAY have changed such that the mobile provision (which we all agree we signed up to) may no longer be legally enforceable.

What we need to know is the basis for this assertion, not that it affects me now. ;) The obvious and widespread lack of sympathy for the Manchester people is one issue, but the enforceablility, or otherwise, of mobile grades will have a much wider impact within NATS.

Does anybody actually KNOW chapter and verse, or is it all a "canteen rumour"?

It wan't my intention to specifically focus on the MACC issue of the move up north, but a serious inquiry as to the "legal" persuance that was mentioned. And not just for NATS, but other ANS providers around, as the three I have worked for all subscribe to that "mobile grade" thing in one way or another.
