Hello All

I am just trying to find the paragraph that states that a holder of an IR rating is allowed to operate the AC at night. (even if the pilot does not hold a NVFR)
I remember this from my IREX exam but cannot find it anymore.

Under Part 61 M

61.855 Privileges of instrument ratings

Subject to Subpart 61.E and regulations 61.860 to 61.880, the holder of an instrument rating is authorised to pilot an aircraft:

(a) under the IFR; or

(b) at night under the VFR.

IFR is with reference to cockpit instrumentation so whether it's night or day is irrelevant. Therefore there is no such thing as Night/Day IFR or IMC. However there are still the requirements for operations at night WRT to take-offs and landings, lighting etc...

VFR at night is a different concept to day VFR as it requires a level of instrument capability, and hence it has an additional rating to allow it.
