View Full Version : Returner Q regarding medicals appeals process

Good morning all,

this is a tale about a returner who began the application process back in July. I found the whole process for SOLI to be full of hurdles and every time I entered the flow chart I ended up at "Must do an initial class one". I couldn't understand this and sent several emails to FCL. I was continually advised I had to do a class one initial. Tried to apply and found the waiting time to be 6 months and typically expensive. I couldn't understand why EASA guys were able to come in with the CAA accepting their medical history from outside the UK. My application stalled. Eventually, in December I was contacted by FCL on the phone to enquire as to why I hadn't continued and explained my situation. This lady offered the alternative route of me presenting all of my EASA info like the others. I had missed this as an option! I asked what I needed to do to proceed and she advised me to simply send in my medical history which I immediately did. My application was safe from the deadline because I had already begun the process. With this email containing my medical history I asked for confirmation that all was in order and of course this was never received. Now I find myself being told by the med section that I have no choice other than to do a class one initial at the age of 63 because I missed the 31st Dec deadline! I wonder if I would be the oldest to do so?

I'm trying to appeal but am not aware of any way through the first lines of contact. I can't get through to any management in order to request an appeal. I know ultimately it's my fault but the situation hasn't been helped by emails taking up to 6 weeks to be replied to (if at all). Has anyone ever managed to appeal something similar or could anyone give me some constructive advice on how to proceed please? This situation has already cost me a transfer to my home base and I'm hurting.

Did you ask your EASA state of licence issue to send a copy of your complete medical record directly to the U.K. CAA? I did this and, before long, received a U.K. issued Medical certificate with the same validity dates as my latest EASA medical certificate.

The process seems a complete mess, and it might be worth consulting now with a law specialist to discuss the way forward using legal action if necessary and to recoup and have awarded the financial aspects that you have lost as a result in a hearing and judgement (assuming favourable outcome).
