Is anyone looking at applying for new UK FCL based on EASA FCL and previously holding UK EASA FCL.? Still no sign of a link on their online applications site.
guess they will also want an admin fee for data they already hold .

I will be. I think this doesn’t start until Apr. There will undoubtedly be a fee!

When the ICAO requirement for ELP was introduced, the CAA reissued all existing licences free of charge yet now that they are about to reissue a much smaller number of licences as a direct result of UK action they propose to charge the full issue fee. Perhaps they should be challenged on this.

But there is no need to have a licence reissued just to remove 'EASA' from the cover. Those licenses with EASA on the cover are deemed a UK FCL licence for its life.

If the licence was changed from the UK to wherever in easaland then it is no surprise now that the non UK EASA licence is treated in the same as any other non UK licence. CAA charges have always been outrageous, so nothing new there.

CAA charges have always been outrageous, so nothing new there. But there is a precedent for reissuing a licence FOC when the requirement was not of the holders initiation.

The trouble is that those who 'SOLI'd don't have a UK licence any more, as they had to hand them in to get the EASA one issued.

I made that point in my previous post.

The UK CAA shouldn't have required this however, because it is an EASA only requirement to hold one 'EASA licence'. You can have a UK CAA licence together with any number of other licenses: US, Australian, Brazilian to name only a few and EASA included. The CAA clearly know this. If they can issue a licence after the fact why not also at the time of SOLI, This, for me, should be the argument for the licence to be issued for free even in retrospect. If there can be a justification for a charge then it should be a very small one.

I agree with Whopity and his precedent. Another obvious precedent being at the time of the issue of the now defunct JAA license, The UK CAA told everyone, at the time, that you had to exchange your 'UK' licence for the JAA one - you did not have to, they were incorrect. Nothing barred the holding of both a JAA entitled and also a UK licence. This was much emphasized by Whopity, when he was a servant at the 'Belgrano'. His colleagues found it hard to grasp then as now.

In many cases the new State has not required the surrender of the old UK issued licence, neither has the CAA. On a technical point a State cannot cancel a licence it did not issue, it can only return the licence to the issuing Authority who could simply reissue it to the original holder as the EASA limitation no longer applies. It appears the whole SOLI process has never followed any set procedure.

So the CAA will not transfer any 'restricted' ratings over from EASA part-fcl to the UK part-fcl......
I assume then that a FI rating (restricted) would then not be able to be carried across?

An FI certificate, not a rating is a FI Certificate. The Restriction is just an experience based limitation on that certificate it is not a seperate certificate so you cannot seperate a FI certificate from a FI Certificate with Restricted privileges. I have not seen any mention of FI certificates not being accepted. The issue is one of retaining UK licence privileges for those who may have changed their SOLI.

They should have, as they were part of EASA at the time.

This form is used by flight crew to apply for a UK Part-FCL (A) and/or a UK Part-FCL (H) Licence, when they previously held a UK issued Part-FCL (A) and/or a UK issued Part-FCL (H) Licence which was transferred to another EASA member state which issued their current Part-FCL Licence and/or examiner/instructor licensing certificate prior to the end of the EU-UK transition period on 31 December 2020.

If you hold an Instructors and/or Examiners licensing certificate in addition to your flight crew licence, you cannot apply via this form.
If your Instructor privileges have been varied/renewed/revalidated on your licence since your transfer out of the UK, you may be required to undergo additional training and/or AOC. We will assess this on receipt of your application and may require additional documentation to be submitted and may require additional fees to be paid.

The CAA understands that there are a number of pilots who transferred their licences to an EASA Member State before 31 December 2020, who are still awaiting the issue of their EASA Flight Crew Licence. To allow these pilots to continue operating UK-registered aircraft, the CAA has issued a Validation to grant such pilots who obtain their EASA licence between 1 January 2021 and 31 March 2021 the ability to do so. As such, these pilots will be able to use this application form to obtain a UK Part-FCL.
