How does this come to be classified as an accident? As far as I can see there were no serious injuries and no damage or structural failure to the aircraft.

"Accident" appears to be only in Avherald's judgement.

The CIAIAC (Spanish AIB) has classified it as an serious incident (IN-039/2019): Accidentes e incidentes graves acaecidos dentro de territorio espaņol (https://www.fomento.gob.es/organos-colegiados/ciaiac/investigacion/2019)
