Dear friends hello,
I currently hold an EASA ATPL(H) with AS332 Type Rating and I have finished my training in R44, but when the day for my TRE came, the examiner told me that he can't perform the examination because he holds an EASA CPL(H). As i discovered later when I contacted the Hellenic(Greek) CAA, I must be examined by a TRE who holds an ATPL(H) like me.
So my answer to you is if anyone knows if this is correct and if you have any solution to propose, even if this means to travel to another country and fly the examination, or contact with a TRE and pay him to come to Greece and fly the examination flight.
Thank you in advance and always have safe flights and landings.

That is how some countries interpret the regulation, but what the regulation actualy says is:
FCL.1000 Examiner certificates
(a) General. Holders of an examiner certificate shall:
(1) hold an equivalent licence, rating or certificate to the ones for which they are authorised
to conduct skill tests, proficiency checks or assessments of competence and the privilege to
instruct for them;
(2) be qualified to act as PIC on the aircraft during a skill test, proficiency check or assessment
of competence when conducted on the aircraft.
The TRE holds an equivalent rating and is entitled to act as PIC so may conduct the test. He is not conducting an ATPL Skill test and therefore does not need to hold an ATPL. Sadly, the halfwits in some NAAs don't seem to understand this.

Thank you very much, do you happen to know how they confront this issue to those countries?
Also I would like to ask if someone with atpl can issue a simple ppl for the r44?
Thank you in advance

The UK treats the regulation as it is written, if not we would soon run out of examiners. An ATPL holder would need the same Instructor/Examiner certificates to train and examine PPL as a CPL or PPL holder. To examine, the Examiner must hold a qualifcation at least equal to that which he is examining for. So if examining for a licence then the Examiner must hold that licence, but in the case of a rating, they must hold the rating, Type, Class or IR.

Would you happen to know someone with atpl (H) FE(H) and R44 type rating?

Indeed! I had this point clarified at the 6th FCL TAG/subSSCC meeting held at EASA on 2 Dec 2015. It was confirmed that the regulation should be interpreted exactly as Whopity describes.

But some NAAs are still too dim-witted to do so. One CPL/FI whose medical had dropped to Class 2 was told that he couldn't instruct any CPL holders (e.g. Class Rating refresher flying) for remuneration. Which was double bolleaux!

manthosn (https://www.pprune.org/members/373569-manthosn) I think that it's your licence's state of issue that counts, not the examiner's, so
- either you find an examiner who holds an ATPL(H) with R44 rating, even with a non greek license,
- or you change your state of license issue for another one and then you can choose any examiner, even with a Greek license, without an ATPL(H )
