Can an AME treat you as unfit without informing CAA

As the thread title suggests - is this permitted.

One assumes any serious or substantive concern should and must be reported to the CAA AMS.

Better to make the pilot TU, and have the concerns formally assessed.

It is encouraged by the FAA that the airman provide the AME with a copy of his 8500-8 (the medical questionnaire) prior to the AME officially downloading his application. That way, if something turns up that would otherwise necessitate deferral, it can be dealt with in advance of an "official examination", and save everyone a lot of paperwork and heartache.

Airmen self-certify every time they get in the cockpit. The vast majority of AMEs over here are doing their best to work with the airman to help him continue to do that safely.

As mentioned above, each day you fly you must be personally fit.
As stated on your medical certificate;
MED.A.020 Decrease in medical fitness
(a) Licence holders shall not exercise the privileges of their licence and related ratings or certificates at any time when they:
(1) are aware of any decrease in their medical fitness that might render them unable to safely exercise those privileges;
(2) take or use prescribed or non-prescribed medication that is likely to interfere with the safe exercise of the privileges of the applicable licence; or
(3) receive any medical, surgical or other treatment that is likely to interfere with flight safety

If you are unfit, AMEs want to work with you to get you fit again, this may or may not involve the CAA AMS depending on the circumstances.
For a variety of reasons some pilots do not wish to be fit again, is this the situation to which the OP alludes?

What I mean is this:-

AME No.1 says you are fit, and issues you with a Class 1.

AME No.2 suggests you are not fit, and advises your employer to that effect. However, does (apparently) not pass this information to the CAA.

AME No.2 thereby effectively nullifying the certificate.

AME's are agents of the CAA, are they not? They are not supposed to act on their tod.

It was my clear understanding all unfit assessments had to go thought the CAA. If they don't, then what is the point of both the certificate and the TU processes?
