Part 61 testing officer question

Hi guys,

Long time reader of the forum. Just before the Part 61 stuff kicked in late 2014 my instructor told me that the head of flight training at our school who is also a testing officer cannot do my CPL test when part 61 comes in.

That instructor is gone now and I'm on the home stretch of my CPL and everyone that I ask have no idea about the above statement. One instructor at my school said it rings a bell but doesn't know where it is in writing. So basically I just want to know if any of you guys are aware of this. If you know about it can you direct me to the relevant CAR or CASR.

It is an offence for a flight examiner to conduct a CPL, ATPL or MPL flight test if they are the person who 'recommended' the applicant for the flight test.

The operator should have provision in the Operations Manual for another instructor in the company to 'recommend' the applicant for the flight test if it is anticipated the Head of Operations will conduct the test. If they don't, you need a different examiner.
