Hi all and a happy new year

Long story but Son flew BA Mexico to Heathrow on 24th Dec and 1 of 2 cases did not appear,the one with the presents!

Getting the run around by BA phone help line 'Case found in Mexico and be on next days flight'

But their Lost Baggage tracker on internet still shows as still looking!

Now 12 days and still same story,

Question is if he does not want to claim on his own insurance how long to wait for case to be deemed 'LOST' by BA and BA to agree compensation?

Their booking T&C's dont seem to cover this issue

The air carrier is liable for destruction, loss or damage to baggage up to 1,131 SDRs (approximately £1,000 or EUR1,230). In the case of checked baggage, it is liable even if not at fault, unless the baggage was defective. In the case of unchecked baggage, the carrier is liable only if at fault.

This is as required by EU Regulation (which implemented the Montreal Convention 1999) and applies to all EU carrier flights.

You may have to prove your actual loss.
