Good. It's called FIFO. I'm all in favour of them being allowed to wear their burqas, niqabs, etc, but then they must expect to be treated with circumspection at best and derision and hostility at worst.

It seems to me that an open court system, such as we operate here in the UK, depends on witnesses, the accused, the judge, jury and advocates, being able to see the face and facial expressions of witnesses and the accused.

How can anyone judge the veracity of something said in court if their face is hidden? This is an absolutely fundamental part of our justice system, so the judge seems to have been absolutely 100% correct to insist that this woman show her face in court.

It's not so much about proving identity, in my view, as allowing facial expressions to be seen and interpreted.

When I did jury service I found it very useful to be able to look at the suspect and to gauge his reaction to the various witness testimonies, so in a case like this I would also like to be able to see this woman's face. I'm sorry if that causes a problem because she is Muslim but it would mean that all suspects are accorded the same rights and likelihood of a fair trial no matter what race or religion they are.

BTW I wasn't the only juror who made the same comment about seeing the suspect's face.

The Burka is not a religious piece of clothing. It's an extrapolation of the "being modestly dressed".

Funny, when I was in Saudi, I had to comply with all of their laws. Abbaya, separate screening channels, walking behind my colleague etc....

Maybe it's not only for id purposes that the judge want the burka removed.
I'm not a very good liar as I tend to give the game away through my body language, but if I was hidden behind a bedsheet, I bet I could tell a few beauties and keep up the pretence whilst others were trying to catch me out.

They show their face. In a private room to female officers if requested, but there's always a face to passport check. That's in Australia, anyway; I'm not aware of anyone having an issue with it. Many women don't bother with the private room and just lower their face covering without being asked.

I'd also be interested to know if she is 1. A convert or 2. A British born stirrer. :hmm:

I think the issue (apart from proving ID) is really just about all in court that need to being able to see her face. I doubt that there would be a problem if she just wore a hijab, rather than a burqa.

You live in a country, you accept the laws of the land. No quibbles, no arguments. If you refuse to accept the laws of the land in court, you take the consquences.

I'm not at all sure this is true.

In the case of terrorism offences, or other cases where the identity of witnesses needs to be protected, I believe they give evidence from behind screens or on video, so that only the judge, jury and lawyers can see them, plus reporting restrictions are often put in place. The key thing is that those who are questioning them and observing their responses can see them.

I know for a fact that in when I sat on a jury and we had evidence from a child via video link that the judge, jury and lawyers could see the video and the witness was cross examined via the video link.

One of the few things I picked up from a philosophy course is to try inverting the case being made. If the inversion cannot easily be repudiated there is something wrong with the case being made.

So, the judge, jury, and prosecution witnesses all say that for deeply held reasons that they are not obliged to explain or justify, they will conceal their faces. If the defendant is fine with this, then concede her claim to wear a burka. If however, she says obviously that is wrong it is for her to show why it is wrong. If she fails to do that, she has not made her case to wear the burka in court.

At the Sopar (Dinner) of the Festival de Trobadors in Castelló d'Empurias (held on September 6th this year) prisoners are led in with a rope round their necks, hands bound, to kneel before the Duke and Duchess on the top table. OK, some exceptions are made for members of noble familes who are allowed to walk in.

Their offences are recited aloud either by the knight bringing the charges or some type of scribe, and then following a few minutes consideration and perhaps consultation with a visiting nobleman, sentence is pronounced by the Duke and penalties (where Man decides) such as having throats cut are carried out on the spot, or (where God is to decide) are allowed to fight for their lives the next day in front of the Basilica.

I have been attending the Sopar for some 12 years and have witnessed this procedure on many occasions, and frankly can see little wrong with it. Of course it may be considered somewhat harsh to cut a man's throat for - e.g. stealing a pig - but it sure puts the sh*ts up others at the dinner and serves as an excellent lesson in observing the law.

Truly, in our quest for civilisation, we have lost a lot.

Truly an example of our freedoms and tolerance being abused and being turned around against us. Our country allows them the freedom to practise their religion and establish a Muslim school. They use it to teach religious intolerance and discrimination.

Non-Muslim staff being forced to wear ultra-conservative Muslim clothing and eat Halal food (which I personally find offensive). Girls forced to sit at the back of the classroom. These are not British values :ugh:

Having spent some time on Muslim countries, many of them are far more tolerant than our very own Sharia Caliphates of Luton, Bradford and London. We really need to get a grip of this sort of thing before our standards are diluted into obscurity.

Torque Tonight, having also lived in the Middle East for quite some years, I agree with your observation. The rabid adherence to the more outlandish practices of Islam by Muslims living in the West can be likened to the old adage "patriotism increases directly in proportion to distance from the battlefield". I found most of the Locals (as they are universally referred to by the expats) in the Middle East far more agreeable and easygoing than quite a few Muslims I've encountered since returning to my own country. Many of these hellfire and brimstone zealots would seem to be born here in Oz or at the very least, to have come here as very young children.

The one thing I've noticed repeatedly since returning here is the number of obviously Anglo women wearing the hijab. See the comments above about converts, with which I also agree wholeheartedly.

If you go to Roselands shopping centre in Sydney, (close to Bankstown and Lakemba, Sydney's "Beirut Dunnunda"), I don't think I'd be exaggerating when I say that 20% of the women you'll see there are wearing a headscarf, along with quite a few of the shop assistants. And yes, a small, but noticeable number of the women wearing a headscarf look like they're Caucasian.

When did intolerance become a dirty word?

As kids, we never got up to the same kind of appalling behaviour we see in many of today's kids, because our parents wouldn't tolerate it; indeed, they wouldn't tolerate much lesser misbehaviour. Why are we supposed to laud those who tolerate everything?

My muslim friends in the UK moved there because they considered British culture superior to where they came from. Even they were appalled by the behaviour of the generations who've followed them, who want to bring in the very culture they'd fled from.

No doubt. :hmm: I was referring to Christmas and Easter but that's probably considered excessive these days. :}
My dear cousin is a priest and gets a little bit sick of endless baptism/wedding/funeral requests from people who 1. never turn up and 2. spend their lives bagging out the Church, up until the moment they have a kid, want a big white wedding or need someone respectably buried.

Neither of us have any issue at all with true athiests or agnostics (both are valid points of view) but an awful lot of people see religion as a fashion thing, to be embraced when there's a dress and an Instagram opportunity then discarded once the Big moment has passed.

A story I recently heard was from a couple who had their child baptised into one of the major Protestant faiths purely so they could later enroll it in the relevant private school. :yuk::yuk: Not only was this their reasoning but they told everyone, then got huffy when a few people spoke their minds about how they found this inappropriate.

Now let's say that the couple were truly avowed athiests, loudly announced that their child would not be baptised and would attend a non-religious private school. No problem with that; it's a point of view. However, like many modern 'atheists' they're athiestic but happy to milk the religious system. Unfortunately all too often the churches are happy to go along with this in the interests of numbers.

We can whine all we like about Islamic fundos gaining an influence in our Western societies, but without a credible Christian or atheist oppostion (or even better, both working together) they will continue to claim the moral high ground and grow.

Maybe the churches need to become more relevant to people outside
of the major times like you put.

And I think the church(es) in Aus have been very badly sullied by
the scandals over little boys and girls and the cover ups and then
of course the further hindrance by George Pell etc. Did a lot of damage.

From toddler till I left home I attended church (CofI) and Sunday School every week and like many attended compulsory church parades etc when serving. Since then I have not been a regular, just the odd midnight Xmas service at the "time of goodwill".

I confess to being a "not sure / don't know" although I truly hope there is a better place for us when we die. That said, I'm afraid that the Christianity demonstrated by you and your cousin in your posts does not match what I was taught back then.

All this sends my Muslim friend livid! He already complains about the British being too soft because they don't kick out all the fundamentalist Muslims (although he would agree that it should apply to ALL fundamentalists of whatever religion)......He has the attitude that if you are Muslim and want to live in the west, you live like the westerners......including drinking alcohol, eating pork (especially boudin noir!) and going to titty bars!!

He is French and says if Sharia law is accepted in France, he is emigrating......but we are talking of someone who is educated and with a PhD in engineering.

I suspect the problem is that people like him are in the majority, but at the same time are the silent minority.

I would have thought when the tag was removed, and no one knew where he was, that would trigger an arrest warrant. I really don't understand, or is this another case of the huggy left taking over?

The process for a regular tagged criminal is something like this. A breach of tag or curfew is notified to the monitoring company which then alerts the local police and provides a statement confirming the type of breach. Local police then go to arrest the criminal.

Normally when criminals breach their orders they are arrested and taken either to police custody or to the local Mags court, where they are normally released after seeing the Mag.

Given what has happened in this case I would guess that the controls on the TPIM are different from those of an ordinary criminal, otherwise why wasn't he arrested earlier?
