Fair Work ruling backs unions: report

The right of workers to strike prior to workplace bargaining has been upheld by Fair Work Australia, in a move that sparked a stiff response from employers who have called on Prime Minister Julia Gillard to introduce changes to federal industrial laws, according to a report by The Australian.
But employers are likely to be forced to wait until January of next year before the prospect of workplace law changes resurfaces, when a pre-election review of the laws is slated to launch.
However, the review will not come as a direct response to employers and their concerns about workers' rights to strike, but rather Workplace Relations Minister Chris Evans said yesterday the review is part of a pre-existing plan included in the Fair Work Bill.
The Australian Chamber of Commerce and Industry responded to yesterday's Fair Work Australia ruling, saying that it runs the risk of allowing unions to avoid bargaining and go straight for a strike, according to a report by the Australian Financial Review.
The Fair Work Australia ruling yesterday reaffirms the rights of unions to take strike action against an employer before bargaining begins as well as in the event an employers has not agreed to participate in bargaining, according to The Australian.
