I happened to come across this recently.
Anyone ever heard about this company?? Does this even exist?
Seems more like a scam to me. Easy way to mint money....

This Agreement is made on <state the actual date: the 28th Day of November 2009> at Manila, Philippines by and between:

Eagle Trans Asia Airways Corp. hereinafter referred as ETA which expression shall unless it be repugnant to the context or meaning thereof mean and include their legal representatives, heirs, executors and administrators on the FIRST part

name of student bearing Indian Passport No. ______________and residing at ______________________________________________ hereinafter referred as STUDENT which expression shall unless it be repugnant to the context or meaning thereof mean and include his/her legal representatives, heirs, executors and administrators on the SECOND part

Definitions:

CAAP: Civil Aviation Authority of Philippines

Program: Boeing 737–300/400 Type Rating-cum-Employment Program being offered by the FIRST party

OBS: Observation based training which shall be conducted in the cockpit of B737

SBT: Simulator Based Training for Boeing 737 – 300

PHP: The national currency of Philippines is Philippine Peso. One USD is approximately equal to PHP 48



Now, therefore, it is agreed as follows

The FIRST party is in the business of aviation operations and has appointed Name of Agent , India as an authorized non-exclusive independent representative to promote the Program described below in the following geographical area: India hereinafter referred to as Territory and is willing to offer the Program to the SECOND party. Both the parties hereby agree to the following terms and conditions of the Program and mutually subscribe to the covenants of this agreement.

Program Details
Boeing 737 – 300/400 Type Rating for qualified students who have valid CPL license either issued/endorsed by CAAP.
In case of Students who do not have Philippine CPL, the existing valid CPL (of another country) needs to be converted to Philippine CPL. This process might approximately take about 30 days in time. An additional of One Thousand US Dollar (1,000USD) will be charged to those undergoing conversion or revalidation.
The contents of the course are designed as per the stringent requirements of CAAP upon successful completion of which the Student is eligible for employment in Philippines based airlines
This Type rating program ground training is provided in Philippines which is of approximately four weeks duration
Upon successful completion of ground training, the Student is promoted to OBS Training which is of approximately six to eight weeks duration
The Committee of B737 Captains and the members of the Management Committee shall assess the Student of OBS Training
Upon successful completion of OBS Training, the student shall undergo SBT in Singapore or Indonesia which is of approximately two to three weeks duration
Upon successful completion of SBT, the Student shall be awarded Type Rating on his CPL followed by employment as First Officer (Limited) in Eagle Trans Asia Airways Corp. by FIRST party
Upon employment as the First Officer (Limited) in Eagle Trans Asia Airways Corp., is guaranteed a minimum of 50 hours of flying per month while he is paid PHP 1,000 per hour. It is to be assumed that he/she shall receive a minimum of PHP 50,000 per month. In case the First Officer (Limited) flies more than minimum 50 hours he/she shall receive according to the per hour rate for the total hours flown during the month.
The Employment is for a period of 12 months in the first instance which shall be renewed for another year at the end of first year. Deserving shall not have any difficulty in getting their contract extended beyond the initial period.
The FIRST Party shall also undertake the costs to process Student Medicals, Immigration formalities (in Philippines/Singapore/ Indonesia), Air fare to Singapore/ Indonesia from Manila, Visa assistance, Police Clearances in Philippines and other necessary statutory clearances to work in Philippines.

Program Fee
The total package amount is USD 34,000 (US Dollars Thirty Four Thousand), a USD 10,000 Reservation Fee is required to reserved the slot.

Before commencement of the Program, the Student has to pay First installment equivalent to 50% of the package amount
The balance fee of the Program is paid before the completion of the Ground Training.
Program fees are valid at the time of publication however are subject to change. Please confirm your Program fee before enrolment into the Program
Fee for CAAP theory examinations are included in the Program fee
The Student is eligible to receive Stipend allowance (approximately PHP 25,000) during the OBS period
The FIRST party reserves the right to pass on fee increases to Students when the cost of SBT escalates more than 10% of the Total package cost
The First party incurs additional costs and fees associated with its Federal Government approval to train overseas students and administration in the delivery of training to overseas students consequently, included in the Total package cost. Overseas students are hereby notified that the Program fee for overseas students are approximately 25% higher than for Philippine native citizens

Program Hours
The Student acknowledges that the Program fee quoted and the flying hours therein are based on the Eagle Trans Asia Airways Corp. syllabus of training which slightly exceeds the minimum requirements of the CAAP for the issuance of various licenses/ratings. Any further flying training required by the Student to achieve the required standard will be charged at the retail current rate at the time of flight/training are undertaken. If additional hours are required to get the Student to the required testing standard, the cost of the extra hours and such other relevant costs will be at the Student’s expense. Also the cost of repeating any exams failed will be at the Student’s expense. If the Student fails to complete the syllabus within 6 months period due to unsatisfactory attendance or performance, an additional course fee may be charged. However, the FIRST party shall grant additional time should the absence of attendance is backed by a genuine cause of leave from the place of training.

Discipline
The Student undertakes to abide by the Overseas Student Code of Conduct of the FIRST party. In the Interests of further enhancing Aviation Safety, the Student further agrees to cooperate with the FIRST party in Drug and Alcohol Management Plan and is willing to undergo random Drug and Alcohol testing as required by the CAAP standards from time to time.

Attendance
According the Philippine Overseas Student Visa regulations, students must maintain at least 80% attendance in order to continue studying in Philippines. After counseling and cautioning, students who continue to have unsatisfactory attendance will be excluded from the class and must be reported to the Philippine Bureau of Immigration.

Accommodation & Food
Shared accommodation is provided by the FIRST party during the course and which will be extended during employment period too.
Food is provided by the FIRST party until the successful completion of Ground Training part of the Program only. At the commencement of OBS Training and subsequent SBT the student has to incur the costs of his/her food as he/she would be entitled to get stipend during this period. However, upon regular employment in Eagle Trans Asia Airways Corp., he/she has to take care of the costs of food themselves.

Provision of Information
The Student agrees that he has been given the following information before making the payment and is subscribing to the same
A general description of the content of the Program
The qualification or accreditation gained on completion of the Program
The teaching methods used (including any field trip or work experience requirements)
The assessment methods used
If the training is provided at other location than at the place of FRIST party, that it has been disclosed and all the costs including travel, visa, lodging and boarding expenses are included in the program
The facilities (for example classrooms, furniture, fittings etc)
The equipment (for example audio-visual teaching aids etc)
The learning resources (for example reference texts and software, videos) available to students undertaking the course
Information that upon successful completion and upon obtention of Type Rating that they are provided with the employment with Eagle Trans Asia Airways Corp. by the FIRST party
Information about the minimum level of English language proficiency, educational qualifications and flying experience required for the student to be accepted for the course (unless this is clearly not relevant)
The total package cost detailing inclusions and exclusions of items payable by the Student to get enrolment into the Program upon successful completion of which he secures employment with Eagle Trans Asia Airways Corp. as First Officer (Limited)
That the FIRST party has informed all the intending overseas students accurately of the requirements as detailed in the earlier part of the agreement and that there is no reference or suggestion that they do not have to study or attend classes or pass examinations or seek exemption on requirements to successfully complete the Program
All correspondence with intending students is handled initially through Name of Agent , ___________, India till such time enrolment takes place and thereafter all correspondence is handled with the FIRST party directly
The students also acknowledge that they have been briefed prior to enrolment that no suggestions have been made to them that they come to Philippines on a student visa with a primary purpose other than full time study and employment thereof.

Conditions & Cancellation of Enrolment
A Student is considered enrolled for the Program only upon payment of Program fee as described in Art 2.b above
Students need written permission from the FIRST party to defer or suspend the Program temporarily for a brief period. In cases where permission is granted in exceptional circumstances, the FIRST party has to advise the Immigration Department accordingly
Government regulations do not allow overseas students to transfer to other institutions during the Program period
Overseas students are required to study full time and maintain at least 80% attendance
Overseas students are required to maintain satisfactory level of progress in the Program in which they are enrolled, Students whose progress is unsatisfactory will have their performance reviewed by the Chief Flight Instructor who will make a recommendation on whether the Student’s enrollment should be extended or cancelled in extreme cases. In cases where the Student enrolment is cancelled, the Immigration authorities are duly informed and there shall not be any refund of any amount paid till such time.
Students who are desirous of residing in a private accommodation other than that is provided by the FIRST party, they are free to do so, but such address has to be duly notified to the FIRST party so that FIRST party informs the Immigration Authorities accordingly. No reduction of Program fee is permitted in such a case, while the Student undertakes the costs of such shift in accommodation
In case of any accompanying family members of the Student, they shall seek their own accommodation and comply visa formalities accordingly. They shall not cause any kind of disruption to the Student in pursuing the Program.
Overseas students must maintain adequate health cover for themselves and any members of their family during their stay in Philippines. However, primary first aid facilities are available at the premises of study
Overseas students hereby authorize the FIRST party to share all such details of the Student and their payment details to the Government Authorities or State Agencies upon request without needing any approval of the Student.
The FIRST party accepts the responsibility for information given to overseas students that is provided in this agreement for the Program by Name of Agent in consistent with the terms of this agreement
The FIRST party does not accept any liability for information provided by sources other than those outlined above

Termination
If the Student does not perform his courses with skill and competence reasonably anticipated by the FIRST party to be suitable for the employment thereafter even after all help is extended including the extended duration the FIRST party reserves the right to terminate this Agreement

Complaints
The FIRST party provides the access to Student an independent grievance redressal procedure which provides for prompt resolution of any grievances. Students will be provided with this procedure at orientation. Beyond this grievance procedure, all students have right to pursue further action through the Philippine legal system. This agreement does not remove the right from the Students to take further action under Philippine consumer protection laws or to pursue other legal remedies

Confidentiality
The Student shall not disclose to any third party any confidential information belonging to the FIRST party or any associated company which it may acquire. The Student agrees that all material contained in this agreement is confidential and shall not be revealed to any third party either in part or in whole for any reason without written instructions

Liability
The FIRST party shall not be liable in any manner whatsoever for any claim, loss, damage, cost or expense suffered or incurred by Students in connection with or arising from any operational failings or any act, omission or neglect on the part of FIRST part while executing the Program

Law and Jurisdiction
This agreement shall be governed by and construed in accordance with the laws of Philippines and in relation to any legal action or proceedings to enforce this agreement or arising out of or in connection with this agreement each of the parties irrevocably submits to the proceedings in such courts on the grounds of lack of jurisdiction or on the ground that Proceedings have been brought in an inconvenient forum. In the event that any term condition or provision of this agreement is held to be violation of any applicable law or regulation the same shall be deemed to be deleted from this agreement and shall be of no force and effect and this shall remain in full force and effect as if such term and condition or provision had not originally been contained in this agreement. Notwithstanding the above, in the event of any such deletion the parties shall negotiate in good faith in order to agree on the terms of a mutually acceptable and satisfactory alternative provision or term condition in place of the one(s) so deleted. This agreement constitutes the entire agreement between the parties in relation to its subject matter and supersedes all prior agreements and understanding whether oral or written with respect to such subjects matter and no variation of this Agreement shall be effective unless reduced to in writing and signed by or on behalf of a duly authorized representative of each party to this agreement. Should there arise any differences between the parties to this agreement as to interpretation of its terms and conditions, set forth in the agreement such dispute shall be arbitrated by a panel of arbitrators selected as follows before any other proceedings: each party to the agreement shall appoint one arbitrator and parties shall mutually agree on one independent arbitrator who shall chair the panel. The findings of the majority of the arbitration panel shall be final and binding.

Commencement Date
The FIRST party will make it available for providing the Program as specified above and the date on which both parties subscribe their signatures to this Agreement



Notice
Any notice under this Agreement shall be deemed given on the third business day following the mailing of any such notice, either by email, or in case of mail where postage paid to the address set forth above

This Agreement contains the entire agreement between the parties and any representation, promise or condition not incorporated herein shall not be binding upon either party

I declare that the information I have provided is true and correct, that I have read and understood the FIRST party information for Students and the Code of Practice and agree to be bound by the Terms and Conditions of enrolment in the Program which I have also read and understood

STAY AWAY!

What 737-300/400s are they talking about? and what SIM?. Only PAL has a FFS for the classics which has been offline for a long time now! The other SIM is an A320 belonging to 5J in Clark Aviation.

Dont know of any local commanders jumping to this "airline":= they plan to train every pilot from zero?

And regarding the simulater training....they said they r planning to send students to indonesia....is it possible ???..even Zest air doesn't have sim....please reply

Well to be honest , does not seem fraud to me...i am one of the student here in Eagle Trans Asia and things seem pretty good....We have experienced and highly professional Captains here from All Nippon Airways and qualified instructors From Philippine Airline
Its been two weeks since the ground classes started....and all seems well...They are not only buying 737/300/400 but also buying a couple of BAE 146-200...
Being a new airline , they are facing hindrances but I guess thats obvious...
Mr. Nino Louis A Jamili, the president of this airline was a flight inspector in CAAP and a well renowned person here ....
Guys as they say , Dont jump to conclusions and wait for the results...So lets wait for the results for this youth airline ...

I know of one ex-DAL pilot that lives in the Philippines, now, that might be responsible for all this.
However, he has bilked many out of funds before, with a non-existant aviation agency.
IF it is the same fellow, stay far far away.
Just some friendly advice from a guy whom has been around a long time, and has seen this type of modus operande before.

411A. I think you have the wrong person. I know the president/owner of ETA and he is not a pilot. He has however, 5 sets of B737 crews ( all Filipinos) already for the airline and 737 students. There is also one Filipino trainee F/O hired as well.

So, let's not jump into conclusions and hang the man before he is found guilty.
I think "Crab Mentality" is again about to show it's ugly head.

hi 411A, I don't condone scamming people as well. If he is a scammer then damn him to hell.... but let's give him a chance to prove himself as a lot of the B737 crews that got laid off from Air Phil has another shot of being employed not to mention the new trainee pilots (Indians and Filipinos), cabin attendants and others. I too would want it work as a friend of mine (pinoy) has been hired by them too.

Apparently, they will also be getting BAe146, 733/734s, and a 767

A question to the posters who say they are employed/enrolled with this airline...Who is the owner? or who are the financial backers? B737,BAE 146, B767....a huge varied fleet for a small startup...and talks of buying aircraft off the shelf...literally! what routes do they plan to start? :confused:

Ex CAAP inspector is the airline president? hmmmm no wonder things might be moving at a faster pace than usual! hope no safety norms are flouted!:rolleyes:

I was one of the few people who were initially approached for this program.
It stated with the name of SEA AIR then became Eagle Trans Asia.
I just want to know when are the aircrafts coming???
Also their proposed fleet is too big.
The route that were told to me were Manila to HKG and Manila to new zealand.
lets see what happens.........

Come on guys it is totally crazy that a start up airline (which would therefore NEED to attract people to join) would ask your money up front for a "training" program. This is a clear scam!

So does anyone know who owns this "airline"? When are the aircrafts expected? I too heard about this program being advertised by the agents as SEAIR's venture...but as we all know now...SEAIR has flatly denied it.

This guy Mr. Luis Nino Jamili is quite a character. I know where he lives as he is renting our place.

He operates CORAL Travel and Tours.

Korean Guests are his focus. He will have them pay a certain fee, have then fly around Cebu Island using a leased 4 seater airplane.

to commit fraud you at least need two people: the fraudsters and the defrauded. Does that mean we Pinoys are more intelligent that Indian people? I admit many people in CAAP are involved in gimmicks and fund raising activity but the fault is not only with us. Its also you who make it possible that this fraud is happening because you want to get your license with fraud. this is a two way alley and not a one way street. If you Indians would go the straight way, CAAP has no chance to squeeze money from you. Because many Indians are not straight CAAP can squeeze money.

No lets not deviate form the topic shall we?. you are taking things too personally and rambling to a level at which it is irking other guys who are trying to do things in the right manner here in the Philippines respecting people and maintaining values. lets maintain decorum and not get too personal (r_cist ) this forum is to provide experiences and info to stay away form scams, i understand the frustration that comes form reading what avio_badal has scrambled ( may be he is also a victim ) and i ask the apology for that as an Indian. You are just making a mockery out of yourself just by saying that the CAAP licenses issued are Fraudulent ( makes me and you Fraudulent guys also right? ). I have seen money being paid for expediting things ( we all know about the Philippine standard time right :O ). @ ckalli: YOU ARE RIGHT!! Luis Nino Jamili did not come to our term of agreement with paying rent. He paid partial but still owes me 120k Philippine pesos.

The 17 year old nephew of his is actually a lady niece named Jellian Gaynor T.Jamili.
I received a subpoena yesterday from the Police as this Luis Nino Jamili complained that I made a remark here that 'destroyed his reputation' :ugh:

Its an ORAL DEFAMATION case. :ok:

I know Luis Nino Jamili wants to make a big fuss out of this, so lets wait for more updates. I hope he has budget for his lawyers.

hes only contact with the law is in pasay court, manila. (guy named henry, DOJ office)

if the case is anywhere else dont worry.

if u enquire with the CAAP manila, you can find out more abt his reputation.we submitted proof and all documents of what all her did

even the white fortuner he drives has been brought from manila to cebu so that the bank cant repo it.

u want to hit him where it hurts.. get the car seized. from what i understand the bank also is owed alot of money. but they dont know where the car is.

With regards to his White Toyota Fortuner, he already leased it to his friend who pays monthly rental fee to Mr. Jamili. His Fortuner was hit by a truck when he made a landtrip from Manila to Cebu. Case of Karma.

Yes, we are Cebu based. The property that Mr. Jamili rented was once owned by them. It almost got repo by the bank until their mother sold it to us.

His former partner from Aero Equipt Aviation, Mr. Sunga informed me everything that needs to be known.:eek:

i was told by my co-lawyer to check on this blog site topic regarding Mr nino jamili & Mr john velascos conflict and subsequently to make comments
we have found interest in the issue because its really hard to determine who is good and bad guy here Mr jamili dont seem to protect his self against the blatant comment of MR velasco and others however as a lawyer if its really true that Mr jamili has filed several cases against Mr velasco then Mr velascois in big trouble especially that mentioned a supreme court judge relatives this one alone being read by other foreign nationalities is an insult to the judicial body of the phils if coral air does exist and operates also then Mr velasco has ststed here would be considered libelous Mr velasco is like a crazy guy mentioning that he will sue somebody for destroying the building but now hes clameing to have done such i guess mr velasco mentions here also the exact name and identity of the person guysyou better not alow him to do such especially if your a foreigner you would be surprise ull receive a subpoena some day for being a part of a demolition job against Mr jamili i would go for mr jamili on this matter get me ur lawyer well earn from this :ok:

What ancestral house are you pertaining to?

I know the Jamili Family and I've seen their ancestral house its an old spanish house situated in a very huge lot property.

This JOHN VELASCO is making stories first he claimed its their property destroyed by the Jamili and now he is delighted to destroy the ancestral house of the Jamili into pieces, its crazy.

The Jamili has several lot properties in Cebu and in some provinces, maybe JOHN VELASCO'S FAMILY NOT HIM has bought some land from the Jamili and he presented like he has bought everything.

I know you also MR. ROBERT VELASCO, JR. including your family line but I would like to contradict your one statement here regarding your family support, well I bet you with what you are doing now, I bet they're not gonna support you at all....
