Good day,
I see in the JAR-FCL 3 there are a number of conditions for which the following applies:
"...shall be assessed as unfit. A fit assessment may be considered by the AMS in compliance with paragraph...".
Now, my question is: _assuming_ the said condition complies with the specific fit assessment guidelines, is this fit assessment discretionary by the AMS? In other words, could I run into an AMS who simply refuses a fit assessment, while another AMS would have done it? Or, in even other words, do I have the "right" to request the fit assessment (again, _assuming_ the condition complies with the fit assessment guidelines)?
