A couple of genuine questions for anyone that is in the know, as i am trying to make a decision regarding joining the AFAP or not.

Is there any truth to the rumour that is going around that the AFAP are not prepared to take on the VB management to try and enforce the last on, first off clause in the EBA?

And in the event that it is the case, how can the AFAP truthfully claim to be the preferred choice for pilot representation in Australia?

Does the AFAP have to be involved or can affected VB crew take it directly to court on their own and win?

Surely you would be able to lodge for wrongful dismissal against the agreement.

We intend to go court if management try and overturn the 'last on first off ' provision in the EBA. The reality is however, due to the Dudd government's backflip on the Workchoices legislation, they have a chance of success. Stay calm, consider the options when they are offered,then decide.
As one of your elected reps, we are taking advice from all VB pilots,AFAP MEMBERS OR NOT. You don't have to be a member but it helps. Don't be a sniper like some, we are here to listen to what you have to say, only do it inhouse.

What specifically is the issue with current laws which might allow the company to make redundancies, or any other decision, outside of an EBA?

So one of the worst CEO's in Australian history is entitled to a bonus yet when the pilots are offered either a demotion or redundancy they should simply "decide".

Gotta love the Feds, not a word about incompetant managers or airline management using an economic downturn to achieve employee manipulation by means of an EBA "get out of jail free"clause.

Nope, just wait for the pineapple and "decide".

The Rudd Government has lied and tricked the Australian public into swinging to vote for them with the lie they will reverse the Howard Governments Work Choices Laws. Reverse them, wonderful I will vote for Rudd, if only it was true in its entirity.

They are reversing some of the minor points but when crunch time comes the main issues are not being changed.

In my view one of the things that should be reveresed is the wage determination powers of the Industrial Relations Commission (generally a Full Bench sitting); these will not be coming back! So we end up with this fairness testing. We are yet to see what Dudd (rit) can get through the Senate. So who knows where we will stand with regards to arbitration which they seem will be leaving up to the concerned parties and leaving the Commission powerless :ugh:

In terms of what has happened to the powers of the Commission with regards to Management breaking a clause in the EBA I am not 100% sure, worth emailing the Federation and they can clarify your legal position.

In regards to taking your own legal action, will cost you a fortune in long drawn out cases....hence why we have the Federation to appear for us and bear the costs.

One thing that really peeves me off is people like 6100 who only want to join the AFAP or any association for that matter when they have a need to and leave everyone else to pay the subscriptions and contribute to the running costs and the building up of a war chest during all the good times.

These are the same people who then immediately resign membership when their own personal selfish interests have been served.

Stop expecting others to fight your battles for you, one of the big reasons Unions are finding it harder to support their MEMBERS.

AS one who has been affected in the past and a member of the AFAP you cannot rely on them or your work colleages no matter what is in the EBA. You will find that those that aren't affected won't care and those that are, will fight tooth and nail to protect their position and management will support the popular vote.
AFAP are restricted by cost and the rest are purely self serving. People carry on about being united and I have no doubt that your pilot rep's are working their rings off, however I have seen it a million times that all their good work is undermined by a few who are so short sighted that they just dont get it.
I wish you good luck and I hope Virgin look after their Pilots as the valuable commodity they are.
