KUALA LUMPUR (AFX-ASIA) - Former Malaysian Airline System Bhd chairman Tajudin Ramli and three other senior executives have been accused of. .management irregularities in a police report, the Asian Wall Street Journal reported, citing current MAS chairman Azizan Zainul Abidin.

Azizan told the newspaper that the police report alleges Tajudin and three other former senior executives at the airline were involved in. .management irregularities, focusing in particular on several transactions involving the cargo division during Tajudin's tenure as chairman from 1994 to 2001.

"It's now up to the police to decide on the next step," Azizan said, declining to elaborate on the police report's allegations.

Senior police officials confirmed that an investigation into Malaysia Airlines is underway, the AWSJ report added.

The newspaper also said that the government is pushing for Tajudin to settle some 1.0 bln rgt in personal debt, which is now under government. .control through the Penguarusan Danaharta Nasional Bhd debt collection agency.

The debt is secured by Tajudin's stakes in Naluri Bhd and Technology Resources Corp Bhd.

"He has got to come up with a plan soon. All we want is to protect" the agency's interest, a Danaharta official was quoted as saying.

The AWSJ report said the move is part of Prime Minister Mahathir Mohamad's drive to clean up some of the country's most heavily indebted. .corporations, many of which have avoided painful restructuring due to political connections.

The Asian Wall Street Journal earlier quoted current chairman Azizan Zainul Abidin as saying a police report has been lodged alleging former chairman Tajudin Ramli and three other senior executives of management irregularities.

Malaysia Ratchets Up Pressure On Tajudin and His Empire

. .KUALA LUMPUR, Malaysia -- The Malaysian government is increasing. .pressure on businessman Tajudin Ramli, the former controlling. .shareholder of the country's beleaguered national airline.

A police report filed by Malaysia Airline System Bhd. last month. .accuses Tan Sri Tajudin and three other former senior executives at. .the airline of management irregularities, focusing in particular on. .several transactions involving its cargo division while he was running. .it, according to MAS Chairman Azizan Zainul Abidin.

"It is now up to the police to decide on the next step," Tan Sri. .Azizan said in a rare interview. He declined to elaborate on the. .report's allegations. Senior police officials confirmed that an. .investigation into MAS's allegations is under way.

Separately, the government is pushing Tan Sri Tajudin to settle about. .one billion ringgit ($263.1 million) of personal debt that is now. .under government control. Tan Sri Tajudin's failure to repay or. .restructure his borrowings could result in his losing control of his. .business empire, according to senior Malaysian government officials. .and bankers. Tan Sri Tajudin didn't respond to requests for comment.

Reversal of Fortune

The moves against the once high-flying executive come as part of Prime. .Minister Mahathir Mohamad's drive to clean up some of Malaysia's most. .heavily indebted corporations, many of which have avoided painful. .restructuring because of political connections. In particular, Dr.. .Mahathir has sought to restructure several debt-laden concerns. .controlled by associates of Tun Daim, who was long one of Dr.. .Mahathir's closest advisers before falling out with the prime minister. .last year. Since assuming Tun Daim's finance ministry portfolio last. .June, Dr. Mahathir has broken up several Daim-linked companies in an. .effort to improve Malaysia's corporate image for international. .investors.

In July, the government took control of Renong Bhd., one of the. .country's largest conglomerates and the former investment arm of Dr.. .Mahathir's ruling party. Renong's then-controlling shareholder and. .executive chairman, Halim Saad -- another Daim protege -- was removed. .from the company's management team. Since then, Kuala Lumpur has also. .moved against other once politically influential concerns such as. .Malaysian Resources Corp. Bhd. in a bid to speed debt-restructuring. .efforts.

Foreign and local investors appear to have welcomed the cleanup,. .lifting the benchmark Kuala Lumpur Stock Exchange composite index. .nearly 13% over the past two months.

Still, the government is continuing to struggle with its controversial. .bailout of MAS in January 2001. Senior government officials privately. .acknowledge that the MAS rescue -- arranged when Tun Daim still served. .as finance minister -- hurt Malaysia's credibility with foreign. .investors. "This will send a signal that we are serious," said an. .official familiar with the current police investigation into MAS's. .affairs.

. .Early last year, the government paid Tan Sri Tajudin's company, Naluri. .Bhd., 1.79 billion ringgit for its controlling 29% interest in MAS.. .That deal valued each MAS share at eight ringgit. That was the same. .price Tan Sri Tajudin paid the government for his stake in the airline. .in 1994, but a 250% premium over the price at which MAS shares were. .trading at the time. And the deal came just weeks after a Malaysian. .government-pension fund bought the Brunei Investment Agency's 9%. .interest in MAS for four ringgit a share.

The resulting public uproar over the MAS rescue exacerbated an already. .widening rift between Dr. Mahathir and Tun Daim, who resigned his. .finance post in June.

After the government took control of MAS, it ordered an audit of the. .airline's affairs during the period Tan Sri Tajudin was the. .controlling shareholder. The police report filed by MAS last month was. .a result of that audit, according to senior government officials.

The report, lodged with the Malaysian police's Commercial Crime. .Division, focuses on several transactions involving MAS's cargo. .division during Tan Sri Tajudin's tenure as the airline's controlling. .shareholder and executive chairman from 1994 to early 2001, according. .to MAS Chairman Tan Sri Azizan.

Kuala Lumpur is now trying to reorganize MAS, which is saddled with. .debts of about 9.2 billion ringgit and has posted accumulated losses. .of more than 2.5 billion ringgit. Last month, the government announced. .that MAS would be taken private, with a government-owned concern. .assuming all assets and liabilities of the airline, including its. .unprofitable domestic routes. MAS's listing status on the Kuala Lumpur. .Stock Exchange will then be transferred to a new company, which will. .run the airline's cargo and international operations under a 30-year. .concession from the government.

The police investigation into MAS comes at an awkward time for Tan Sri. .Tajudin, who is struggling to retain what remains of his. .once-formidable business empire.

Those struggles could get more difficult as the government presses him. .to settle his personal debt, now under the supervision of Malaysia's. .debt restructuring agency, Pengurusan Danaharta Nasional Bhd. The debt. .is secured by Tan Sri Tajudin's equity stakes in two listed companies,. .Naluri and Technology Resources Industries Bhd., or TRI, which. .controls Malaysia's second-largest cellular phone operator.

A former merchant banker and manager of businesses affiliated with Tun. .Daim, Tan Sri Tajudin secured government approval in the late 1980s to. .acquire a cellular-phone business owned by the national. .telecommunications company, Telekom Malaysia Bhd. That company, Celcom. .Malaysia Sdn. Bhd., is now a subsidiary of TRI.

Debt Plan

TRI is currently attempting to restructure almost 3.8 billion ringgit. .in debt. Company officials have said that Tan Sri Tajudin intends to. .subscribe to new shares offered by TRI under a restructuring plan so. .as to remain the company's single largest shareholder.

But the Malaysian government has placed obstacles in Tan Sri Tajudin's. .path. Late last year, the Malaysian Securities Commission blocked a. .bid by Tan Sri Tajudin's Naluri to use the proceeds from its sale of

MAS to invest in TRI.

The government's demand for repayment further complicates matters.. .About 40% of Tan Sri Tajudin's shareholding in Naluri and 20% of his. .stake in TRI have been pledged as security for loans owed to Malaysian. .banks that have since been transferred to the debt-restructuring. .agency, Danaharta, for collection. "He has got to come up with a plan. .soon. All we want is to protect" the agency's interest, a Danaharta. .official said.

Since the Malaysian government is just as corrupt as Nams, therefore it follows Dr M and his croneys would be implicated in any investigation? Seems to me its just a floor-show to shutup the bloodey critics. All butts are probabley heaviley tin-plated by now so the timing is good. Mere police reports mean nothing here and probabley mean nothing in Malaysia too. Like other events where corruption and wastage of funds come to light (with the prior government green-light) Id assume Dr M and his butt-lickers are waiting for the locals to forget about it in time. Worked with Anwar didnt it? Works well for the commies here too.

Read Tuesday Star newspaper about the matter. Very interesting, as I could see the spokeman (The Dr.) confirming that the police report was lodged by the airline. And....guess what? It's a real joke that the same person was the "head organiser" for the Rally of Support to the former Boss a few years ago at the MAA premises.

Yes I agree with Slasher that it is all just another con job by no other than Dr.Con himself.

Even if your own sister get raped and murdered the police report will not help much unless you're willing to give some money under the counter for investigation to begin. The police force had lost their credibility a long time ago. They are there to protect the rich and the powerful politicians. Not you and me. Period.

They just did this to cool down the restless atmosphere among MAS staff and to score some political points. Hoping that in time as usual matters will be forgotten.

I totally agree with you, man, Dr Con used to think the sun shone out of TR's A***H**E. It was TR that made him SVPFO at a meeting in LGK, probably on one of those yachts that dissapeared. Is'nt it funny where honour lies. One would think Dr Con would have resigned rather than forward the police report after all he is due for retirement and certainly does'nt need the money. "Oh Brutus you swine yet another dagger" Definatly no loyalty.

Guys, don't get me wrong I can't stand the TR establishment and those cronies that ran FLT OPS and various other departments/scams but hey this total back stabbing amoungst cronies is an all new low.

MAS restructuring a double government bail out. .. .The 1.6 bilion MAS restructuring represents a double government bail out of MAS after the outrageos RM1.79 bilion buy back of MAS shares at RM8 per share from Tajudin Ramli, said DAP National Chairman Lim Kit Siang.. .. .MAS managing director Dato' Md Nor Yusof yesterday announced that the RM1.6 billion restructuring exercise involving assets sale to raise RM6.1 billion to enable it to retire some of its debts and provide RM820 million as working capital to fast track its recovery back to profitability.. .. .Lim stated that although the asset plans sale plan would provide a lifeline for the national carrier, it is nothing more that a double government bail out.. .. ."Up to now, there has been no proper responsibility or accountability for such an outrageously exorbitant buy back price paid by the public taxpayers, without any independent professional valuation, although the then Finance Minister Tun Daim Zainuddin had blithely and irresponsibly told Parliament last year that MAS was worth RM15 per share!. .. ."Equally disturbing is the Business Times report that the Employees Provident Fund has bought 6.47 million of MAS shares. I only post overseas news on MAS that you don't hear locally. Anyway a lot of the local news had been censured to make its entire materials questionable.. .. .Especially at the time when the TR & Daim had been telling the people that many corporation overseas want to buy MAS shares when in fact in the overseas papers these corporations had denied any interest in the airline.

Sometimes the tears flow. Sometimes they are forced to appeal from a distance - by post. . .. .Tan Sri Tajudin Ramli, former Malaysia Airlines (MAS) chairman and controlling shareholder of the national carrier, falls into the last category. . .. .His main pitch to top Malaysian leaders is hardly groundbreaking. He pledges continued loyalty to the Mahathir administration and country.. .. .He is likely to face a wall of silence for two reasons.. .. .Reason No 1: At Putrajaya these days, they are a touch sensitive to the claim, delivered by many political and economic analysts, that Prime Minister Datuk Seri Dr Mahathir Mohamad is too forgiving of corporate figures who bloomed on government largesse and self-destructed on poor management. . .. .It hurts them like a harpoon in the back. Regardless of all the news, latest news, gossips, predictions and wisdoms, MAS and all of its crew will forever be wishing what their counterparts in other commercially run airlines have and will have.. .The reasons for the establishment of businesses are many and varied. Profitability, Commercially successful, Quality Management, Attractive Dividens and strong earnings growth certainly aren't MALAYSIA AIRLINE's.. .. .With only naive taxpayers to fall back on everytime MAS stumbles, how can the company recover and how can staff welfare be looked at? Forget about the pay rise and comparatively it'll be the lowest in the world in the not too distant future.. .. .MAS surely falls inthe the categ of now defunct players such as SABENA and SWISSAIR, but bandaged and groused up to keep the flag flying. A bloody expensive excercise indeed. It's an empty shell and success is but a figment of imagination.. .. .Good Luck for the future guys and gals..

MAS seeks police probe on fund irregularities

(AFP) Loss-making Malaysian Airline System (MAS) said today it had sought police help to investigate allegations of management irregularities at the national carrier.

"Malaysia Airlines confirms that a police report has been lodged and as this is now a police matter, we are not in a position to reveal further details," senior general manager for corporate services Mohamadon Abdullah said in a statement.

The airline was responding to a report in the Asian Wall Street Journal saying it lodged a police report last month accusing former chairman Tajudin Ramli and three former senior executives of management irregularities.

The police report filed by MAS followed an audit ordered by the new management after the government renationalised it in February.

MAS chairman Azizan Zainul Abidin was quoted as saying that the irregularities focused particularly on several transactions involving the cargo division during Tajudin's tenure as chairman from 1994 to 2001.

"It's now up to the police to decide on the next step," Azizan said.

Senior police officials confirmed that an investigation into MAS was underway, the newspaper reported.

Personal debt

It said the government was pushing for Tajudin to settle some RM1 billion in personal debt, which was now under government control through the Pengurusan Danaharta Nasional debt collection agency.

The debt is secured by Tajudin's stakes in Naluri Bhd and Technology Resources Corp Bhd.

In what was widely seen as a bailout, Tajudin early last year sold his 29 percent stake in MAS, held through Naluri, back to the government at a price more than twice the prevailing market value.

The deal was endorsed by then finance minister Daim Zainuddin, who resigned in the middle of last year.

The report said the moves against Tajudin were part of Prime Minister Dr Mahathir Mohamad's drive to clean up some of the country's most heavily indebted corporations, many of which have avoided painful restructuring due to political connections.

MAS, struggling under some RM10 billion in debt, embarked on a restructuring plan last year to return to the black by 2004.

Last month, it announced it would be delisted from the stock exchange and that it would split its domestic and international operations as part of restructuring plans.

A Malaysia Airlines (MAS) senior employee has lodged his second
police report against a Dhaka-based freight company for allegedly
under declaring the weight of cargo transported by the airline.

It was lodged at the Kuala Lumpur International Airport police
station late yesterday. He had lodged his first complaint on April
21.

MAS cargo senior general manager Ong Jyh Jong and corporate services senior general manager Dr Mohamadon Abdullah were unavailable for comment today, despite numerous attempts to contact them.

Police officials at the KLIA station refused to comment o?n the
matter.


Dangerous practice

Silkways is co-owned by member of Parliament for Shah Alam and
parliamentary Backbenchers Club chairperson Mohd Zin Mohamed. He could not be reached today, but had previously denied knowledge of operational matters.

The company, which is MAS’ general sales (freight) agent in Dhaka, was set up in September 2000.

In his report, the complainant claimed that Silkways Cargo Services Ltd committed fraud by under-declaring the weight of cargo and manipulating the shipment data.

He detailed instances of ‘cheating’. on May 22, he alleged, the
company had under-reported 1,919kg for three shipments of garments on a flight from Dhaka to Kuala Lumpur.

(Freight carried by MAS must transit at the KLIA, the national
carrier’s main operations hub, before being sent to the final
destination).

The discrepancies were between the information storage media (a set of documents processed from computer weighing reading at KLIA) obtained from MAS and the flight manifests obtained from Dhaka where the weight figures were recorded manually.

The complainant said that, at a rate of US$1.87 (RM7.11) per kg, the under-declaration of 1,919kg in this instance would have resulted in a loss of US$3,589 (RM13,636).

He also said Silkways had under-registered another shipment carrying 133 pieces of garments on the same flight, but this was detected in KLIA when the cargo was unloaded.

In his first report, the employee had alleged that between July 14
and Sept 29, 2001, Silkways had offered inducements worth RM1.1 million to several MAS officers to enable the company to slip
through the under-declaration in weight reporting.

Based on rough estimates, he said MAS may have sustained losses amounting to RM3.6 million over the past two years due to the alleged practice.

Under-declaration of weight could also pose a hazard to passengers as it can affect the balance of the plane.


Accountability required

Copies of the police report were distributed to reporters at a press conference called by DAP MP for Seputeh Teresa Kok at her office in Kuala Lumpur this morning.

An ex-MAS employee - who identified himself only as Muhamad - was present, but the complainant was not there.

Kok rapped Silkways for "continuing to commit fraud" while
criticising MAS for not acting against the company.

"Despite lodging a police report, highlighting the issue in
Parliament and forwarding a memorandum to the top-level officers of MAS, the national career is still keeping mum on the matter," she said.

"MAS top management should realise that it is no longer a private
company but a public company owned by the finance ministry.
Therefore, MAS needs to be accountable to taxpayers as well as to the government."

Kok who had exposed the issue at a press conference last month, had then submitted memorandum to the finance and transport ministries calling for a thorough probe.

Political influence

The DAP leader also accused Mohd Zin of using his political clout to
carry out "unscrupulous practices".

"Stern action must be taken against (him) because weight-cheating has caused huge losses for MAS," she alleged.

She said the ‘weight cheating’ had been highlighted in a joint
letter from six MAS sub-agents (freight forwarders) last July to the
national carrier. However, they have yet to receive any feedback.

Kok said MAS’ silence would only lead to public suspicion that
"certain MAS officials are abetting and trying to hide something".

"I will bring this matter up in the next Parliament sitting starting
from June 16," she told reporters.

MAS had earlier denied the claims after a one-day internal inquiry,
but refused to reveal any related documents.

The local law enforcement authority is quite restricted in their ability to pursue the matter.

National carrier Malaysia Airlines (MAS) has dismissed allegations that
its general sales agent in Dhaka, Bangladesh had committed fraud against
the airlines by under declaring cargo weight transported by the airline.

Its corporate services senior general manager Dr Mohamadon Abdullah said
there was "no point" for its agent - Silkways Cargo Services Ltd - to
under declare as the commission given to the freight company was based
o?n the flight manifest record obtained from the final destination.

Mohamadon told reporters this after a meeting with DAP member of
Parliament for Seputeh Teresa Kok yesterday. MAS cargo senior general
manager Ong Jyh Jong was also present.

Ground-handling agent

The issue of weight-cheating claims was brought up by Kok after a MAS
senior employee lodged two police reports against Silkways o?n April 21
and May 26 .

In the reports, the complainant alleged that Silkways has committed
fraud by under-declaration, manipulating the shipment data and offering
inducement worth millions of ringgit to MAS officials to slip through
the under-reporting.

Silkways is a company co-owned by MP for Shah Alam and Parliamentary
Backbenchers club chairperson Mohd Zin Mohamed (right).

Mohamadon also raised several points at the press conference to rebuke
the complaints.

He claimed Silkways does not have the mechanism to make any
under-declaration as the ground-handling agent in Dhaka airport is not
the freight company.

"Our ground handling agent for both passenger and cargo is Bangladeshi
Biman Airlines, the o?nly ground handler at Dhaka airport.

"All air cargo shipment out of Dhaka airport is lodged with the
ground-handling agent who is responsible for preparing the cargo for
uplift, which includes acceptance, weighing, documentation and loading
the aircraft," explained Mohamadon.

He added that the commission paid by MAS to the agent was according to
weight recorded o?n the flight manifest at the final destination and
therefore the agent would not gain any advantage from under-declaration.

The manager also brushed aside the information storage media documents -
copies of which were attached in the police reports earlier to show the
discrepancies - as they were merely for internal references.

"There are o?nly two sets of document that we take into account; the
airway bill (weighing record done at the point of origin) and the flight
manifest and figures o?n these two documents match each other," he told
reporters.

‘Detected earlier ’

Mohamadon explained that the weight o?n information storage media has
led to the misunderstanding because it might include weight of pallets
and other different garments.

Citing example, he said extra weight could be put o?nto another cargo
when the agent received a 1800kg garments but the pallet could o?nly
load 1600kg garments.

"Therefore we might top up the extra 200kg garments to another cargo and
the alleged discrepancies happened here because the information storage
media record done at the Kuala Lumpur International Airport included
this extra weight," Mohamadon said.

On the police reports, he said the cases were detected earlier during
the random pick check. Following that, the airlines has submitted a
discrepancy report and billed the sub-agent responsible under Silkways.

Responding to a joint letter from six MAS sub-agents (freight
forwarders) last July to the national carrier against Silkways for
‘weight cheating’, the manager claimed it was due to "business rivalry".

"Those not selected as our agent must be very unhappy since being a MAS
sales agent is a very lucrative deal. Anyway, Silkways has reached our
target ever year and we will continue utilising their services next
year," Mohamadon said.

To a question that the complainant would not gain any benefit if he had
made a false report, he replied, "You have to ask the complainant".

Monitoring system

Meanwhile, Kok said she was "disappointed and unconvinced" with the
explanation provided by the officials which was "so protective of
Silkways".

"But what I believe is that MAS’ "earlier detection" was o?nly made
after the police reports were lodged.

"They said the discrepancies was detected earlier but documents showed
the airline o?nly billed the sub-agent o?n May 12, three weeks after the
first police report," Kok said.

On her next course of action, the MP said she would first convey the
airline’s explanation to the complainant.
