Hello everyone

I need help
In November 2006 I was promised a place in HMA to start in Jan I was told to pay in full in order to confirm a place so I did RM140000 I waited and waited and I got no place so in Feb I asked for my money back and I was told all sort of stories like one cadet was killed in a plane crash, someone stole money and the company is trying to sort it out. I have now been offered a sponsorship in England where I pay half and the company pays half and I really need the money but still HMA is not giving me my money back it’s been 6 months and I am getting desperate.
Can anyone give me some advice on what to do?

Thanks in advance for all your help

sorry to hear you have to endure such treatment. you can go and talk to DCA about it or try to blackmail them by threatening to write to newspaper. You can also go to TV3 karam singh walia maybe he could help end your ordeal. I understand your problem but i was fortunate enough to start and finish my license in time and schedule. rumor was MAS is flooding the school with their cadets so the priority is for MAS student.

they said HMA is a good school but one of their students crashed in Penang during solo training 2-3 months ago. never heard anyone get killed. But one confirmed rumor is last year they sent one batch home for a holiday because they ran out of avgas. 2-3 week holiday i guess..

being a private student you will always be treated as second class citizen.

Thanks for your help i might write to the DCA and see that happens

This is between the school and you. Believe it or not, DCA lift their hands off.

Let me quote you a piece of info. The flying clubs are facing shortage of instructors but the flying schools will not release or train flying instructors for the flying clubs. DCA can't do anything! Nobody dares to complain to DCA until now. Everybody knows how to make noise, but when it comes to dealing with government, they are wordless. Even DCA received complaint, it is useless and I won't elborate on this.

Don't put too much high hope in getting your money. I don't think you can get it back.
This organisation has a strong policy, and nobody can overwrite.

I have helped you dug-out the Principal's name.

Hello MasterD,
Firstly I wish you had contacted me first over this and I would have advised against you paying the said Company in this Manner. Sadly You didnt know me then.
OK Lecture over, Have you got written documentation of the offer and Transaction? Yes, Good stuff yes write to DCA and send them the proof of said transaction etc. I also advise you get legal advice in UK, 2 methods CAB's (Citizen's Advice Bureau) Malaysia has a similar Dept up Jalan Tun Perak I believe in UK they are probably not up on this sort of Prob but try anyhow. you can also get a specialist Legal Advisor to help you in this prob. It may be worth the cost plus you may get legal aid support (Basically Costs Paid) depending on your circumstances. On top of that I have a Contact Number for a Hi Power legal firm in KL and Can send on if you want, apologies if it takes time as On Hols at the mo but it P@@@@s me off to hear your story.
Hope that will help you.

In aviation nothing is done till you are on the threshold and apply power THEN you are in.

You are screw! once the money leave your hands the only way to get it back is thru civil court (those things take years).

Just keep nagging, and I hope you learned the lesson.
If you can always pay in installments.

Good luck!

Apparently Principal Radzi is no longer working at HMA, don't know who the new principal is.

The Malaysian law system is very similar to the UK, so try get a UK lawyer to send some threatening letters to them, or a good Malaysian lawyer. You have to be very persistent in this case, and then you'll probably get your money back.
You have to understand these peoples mentality - they are corrupt, but then again if you make enough trouble for them, they will give in, as they just can't be bothered.

I wish you best of luck

Here's what a contact said:" I'll see what can I do, but honestly I can't think of anyone who can help him. Perhaps he could try to talk to Tan Sri Halim personally, but I doubt that Tan Sri is going to care this sort of matter, or the management would allow him to speak to Tan Sri.

Maybe someone might know how to contact this guy? This guy's trying to ask asround the school to see who can help. I'll get back to you when I have news.

Good luck man..

MasterD - pm incoming.

Major (R) Radzi was a great instructor. I think he's in APFT now, not sure. Last flew with him in TGG a month back. Bloody good pilot.

Hi masterD,

I've asked a friend's wife who is a lawyer practicing in malaysia. Here's what she said.

Message 1:The small claims tribunal can only handle up to RM25000 and below (peanuts). Your friend will need to engage a lawyer. The first step is to issue a letter of demand (by lawyer) to the school, demanding full refund. If not successful, then need to sue. Lawyer fees cost fromm few hundred for letter of demand, to few thousand for full court case.

I asked what if the school refused to pay after the court order. Reply in Message 2: Then need to take next step where court will issue order to; wind down the school, warrant of arrest; freeze assets...etc. Understand that if school wants to protectreputation, it'll offer to settle with your friend out of court.

Message 3: Just issue letter of demand first and see how the school reacts.

I really hope you get back your hard earned money. Best of luck.

Cheers,

cruiser

1. Full court case for only few thousands? :hmm:
2. Full refund is very hard. :ouch:

Write to the editor of the New Straits Times http://www.nst.com.my they look for stories about foreigners getting ripped off. If they send a reporter to investigate and publish the event, your money will magically be refunded.

Prepare a case with a paperwork trail.
1. Email the school on a daily basis (yes everyday), and cc (copy) your sent emails.
2. Send them registered letters (3 over 9 days).
3. Mail a letter to the UKCAA, Malaysian Consulate, Malaysian Immigration Authorities.
4. HMA is part of the Halim Mazmin group www.halimazmin.com go to their website and send a letter to each director on the board.
5. Prepare your letters with the help of a paralegal, law student or attorney.
Be aggressive, if you are weak or passive, you can kiss your money goodbye.
If you do not get a response in two weeks, than file a case which should include damages for possible loss of a career due to them not returning your money, which could run into millions.
Be Strong, especially if you're considering becoming an airline captain someday.

Master D,

Sue the bastard and don't join the school. You won't be trained to the required standard, and you will be treated second class. Apart from the aircrafts, NOTHING is good.

Better off joining Asia Pacific, who will be using diamond aircrafts which are better-equipped than HMAs. Visited their premises in KB and they are much more organised and coordinated. HMA does NOT have a good reputation amongst students.

Sorry to hear about your case though. Hope you get your money back with interest.
