Why did the MOD payout £5M to the widow before this judgemnent was reached?

This was covered in a recent MoD DS&C newsletter, ISTR they took the view that if it went to court, a judge would find it difficult to rule that the presence of the Sea King had absolutely no impact whatsoever.

Can anyone post a link or the text ?
