AEROCHARTER DE NICARAGUA, S.A. AIRCRAFT SEIZED

This is the Antonov AN-32 aircraft, serial number 3007, seized yesterday by court order.

A cargo aircraft was the object of a seizure yesterday on the runway of the Managua International Airport, as ordered by the local judge of Ticuantepe, against the company Aéreo Charter de Nicaragua, S.A. (Chanisa), for a supposed debt of 444,600 córdobas.

The judge, Oscar Danilo Manzanares, explained that the aircraft was seized and impounded from the manager of Chanisa,
Roberto Estrada Membreño, and will be transfered to the order pf the Sixth Civil District Court in Managua, where the issue will be resolved. At the time the aircraft was seized, Estrada presented a document certifying that the aircraft had been mortgaged to Ikar Plus, S.A., but this did not proclude the aircraft from being seized.

The seizure is the result of a supposed debt that Chanza has with pilot Juan Bautista Espinales, for fees which supposedly were never paid for the application for legalization of the aircraft, according to David Andrade, legal representative of Bautista.

According to Andrade, "They never paid him (the fees). This can be shown in some documents, he (Bautista) has over a two year period of charging the company, in negotiation with Mr. Alfredo Ram'rez, who is the representative of Aéreo Charter in Nicaragua."

Andrade said that the total debt will not be known until the conclusion of the judgment, since it will be necesary to include the costs of the legal process, interest, and devaluation.

Justice Manzanares advised the trustee that the aircraft series AH 32G, registration YN-CGA manufactured in Russia, could not be sold or transfered under the threat of prosecution.

It would be pertenent to mention the that this case resembles other case being heard in the Third Civil District Court, where Juan Bautista is being prosecuted for the crime of racketeering against Chanisa.

A jury of conscience absolved Bautista last year, to whom they attributed this crime for the suposedly false legalization of the same company including the aircraft which came from Colombia.

Meanwhile, in a letter directed to the Contralor'a General de la República (CGR) (general accounting office) and signed by Bautista, he asked for the agency to investigate the aircraft, which had been exonerated from taxes by the Ministerio de Hacienda (Treasury Ministry) without having complied with the established requirements.

The reason this article caught my attention is that I heard that the Mexican carrier Allegro has stopped making payments to Pegasus - the leasing company. Many MD 80s and Super 27s are flying around just in Mexico so that they cannot be repo'd. If Pegasus had been smart they would not have allowed the planes to be registered XA ...

There seem to be other strange things happening with this airline... m_v_s_86 do you know anything?
