Given the amount of evidence that the NAS is a fatally flawed and dangerous model, who if anyone will be liable in the event of a midair collision that can be attributed to changes brought about by the NAS?

If Dick and Mike Smith both believe that the NAS improves safety, then I would like to see both of them held personally liable for any accident that arises because of it.

Forget that.

It will rest squarely on the shoulders of the pilots for failing to 'see and avoid'.

Heard on frequency this morning: "Melbourne Centre, MGC one zero miles Broken Hill request traffic for descent". Confused silence from Melbourne Centre for a few seconds, then the female ATC asked, "MGC, say again distance Broken Hill?" "Ah, Melbourne Centre, MCG one zero zero Broken Hill, I'll get it right in a moment". For those that don't know, MGC is a C550, owned by Dick Smith. And yes, he was definitely the person who made the call - there is no mistaking his voice.
