Swissair trial over
Posting here as I believe it deserve some attention...

it has to be added that it had to be expected that the public prosecution clame never had a chance to succeed, while there is still a great chance that the civil case will do. The former was about jail or not, the second is about money compensation for the damaged parties.

The thing is that having won the public case your chances of winning the civil case are higher. And seing the complete underperformance of the public prosecution the chances of nothing but more public money being spend are rather high...

that might be correct but just because its chances are low doesn't mean that you shouldn't spend taxpayer's money. *That* would be a sign of a not working public services. You simply cannot stop a juristical process because you don't believe in its success. It's also important to find out that there wasn't anything illegal there - at least nothing illegal enough to jail them.

The case was not about tax fraud or document falsifications. The case was about distruction on purpose of shareholders money. Since you need a willful intention for a sentence (otherwise its just bad luck of your business), they couldn't punish anyone.
Atakacs, have attended the court sessions in Bülach? I was there, and I reaffirm that every official person (prosecutor and justices) didn't try to spare anyone. In the civil process everything will be different, because there you can sentence someone even if his intention wasn't malign. Dani |

More news... the Belgian state has appealed, so I guess there will be a second trial after all... :ok:
