That will all depend on whether Manston is re-opened as an airfield & on whether, or not, it is successful. I hope that both will happen - but I am not holding my breath. There still appears to be an awful lot of wishful thinking & romanticism attached to this. But, I don't mind if I, too, get egg on my face !

The fact that Riveroak have transferred a relatively small sum of money to their solicitor client account is irrelevant. Anyone can do this at any time. What the council are asking for is solid proof that this company can underwrite the astronomical costs of very long CPO process which at the very least involves Public Interest Test, Public Inquiry, Judicial Review, Compensation to the legal owners, And market value purchase of the land. The company has had a very long time to provide this proof and has not yet done so. Many are beginning to believe that none of this is in the interests of the people of Thanet

This sum of money is sufficient to see the CPO process through to the point where the Government appointed inspector pronounces on the price of the land.
Then and not before this remaining sum can and will be provided.
This initial sum is all that TDC need to start the CPO process and announce RiverOak as Indemnity Partners, and take the process up to the inspector's enquiry.
"deedave", please go and read the government CPO guidelines, your understanding is faulty.

No. Thanet Council needs to see evidence that Riveroak can finance the whole process. Thus far the council tells us they have seen no such evidence. CPO guidelines are not the issue. The CPO itself constitutes a massive political risk for this council and to embark on such a venture without guaranteed funding is political suicide.

Not that all the funding is now available - it can not be, as until the Inspector pronounces, no one else can claim they know how much the land will cost.

You appear to have no knowledge of recent history in Thanet :
TDC have been entrusted by the electorate with returning Manston as a working airport. 52 out of 56 Councillors were elected on such a basis, and have already voted once (with just 4 abstentions and none against) in support of the CPO.

The guidelines on CPOs are quite clear on this :
"Were they to act in breach of trust they may be liable to their authority."

Recent events in Thanet have been largely dictated by the presence of UKIP both at Parliamentary and District council level. There are probably a few hundred votes across the district to be garnered by adopting a pro-airport stance- though the population has never actually been verifiebly asked if they want an airport or not. Ruth Bailey stood as "Manston Airport Independent Party" candidate in the general election and polled 191 votes. The population was asked some time ago if they wanted night flights and voted 2:1 against. This is the only airport-specific information we have. Both UKIP and Conservative took a pro-airport stance at the council elections but of course this is only one policy out of many. The fact that UKIP were elected says more about the political complexion of Thanet than attitudes to Manston airport.
It might be reasonable to assume that other parties would like to see this UKIP council fail. Now that the Conservatives are safely on the sidelines they can watch how UKIP deal with the poisoned chalice of the CPO.

If the council do not proceed they can be accused of failing to fulfill their election mandate.

If they do proceed and fail they can be accused of wasting time and the valuable regeneration opportunities being offered by the new owners of the site.

In the unlikely event the CPO succeeds, then we are left with the same failing mess of an airport we have had for the past 16 years and UKIP are once again to blame.

It will be interesting to see which form of execution they select

RiverOak continues to seek meetings to resolve TDC’s outstanding issues – 25th August 2015

During the entire 18 months of the CPO discussions, we have always known and sought to assure Thanet District Council (TDC) that there would be no risk to TDC under our partnership indemnity agreement.

We have already deposited a substantial amount of money in an account to reassure TDC and we have spent considerable time and money assembling a full team of experts in the CPO field including legal, evaluation, planning and due diligence experts among others, who are lined up to proceed once there is an agreement between RiverOak and TDC.

We have continually let it be known that we think meeting face-to-face would be far more useful, productive and conducive to making real progress than receiving indirect communication through aggressive website postings. We had a senior team in England for 17 days in August but were unable to secure a meeting. We were requested to provide dates for the first week of September but when we did, we were met with complete silence.

We will continue to make every effort to hold an all-hands meeting with elected officials, officers and solicitors to bring any outstanding issues to closure so that we can all move on to the next phase of this process and restore this vital piece of UK infrastructure to full operation.

Riveroak, an American company with extensive experience in Real Estate investments seem very keen to get their hands on the land at Manston and claim they want to run it as an airport, although we are told they have never run an airport before. It seems they are willing to suggest meetings, move money from one account to another, and issue numerous press releases. The one thing they are not willing to do is supply Thanet Council with the written information they have asked for- where is the money coming from? The only letters they did supply apparently had the important information blacked out. Astonishing.

On another note, on wonders on what grounds the company can claim Manston was a "vital piece of UK infrastructure". Apart from the loss of 144 mostly part-time jobs it's closure has had zero impact on commercial UK aviation.

Sadly as the current situation and legislation stands operating freight and positioning aircraft under CAP 168 does not require the aerodrome to be licenced so no need for RFFS facilities, however, if the CPO does come off Manston would not be a licenced aerodrome. 2016 will see UK aerodromes transition from either licenced or un licenced aerodromes to EASA certified aerodromes, EASA does not make any distinction between freight/positioning/training/end of life or passenger aircraft, they class them all as a movement and as such must have RFFS facilities in place relative to that of the size of aircraft, should there be less than 700 movements of that aircraft in the busiest 3 consecutive months of the year the RFFS may operate at 1 category below. Remission is back!!!!!!

But EASA does remove approved training providers so Manston can choose who/how/where it trains its firefighters and for how long. This would all have to be proved through a Task Resource Analysis which the accountable Manager would be up in front of the judge should it all go wrong.

EASA is a minefield and expensive to transition from CAA!

Some more relevant information appearing online-

Reading through a thread on another Facebook site we came across this very illuminating insight from a former TDC Cabinet member, David Green. When asked why he had felt personally convinced that RiverOak were not suitable indemnity partners, he had this to say:
"When I asked Riveroak face to face, whether 1. They would ever disclose the source of their funding, they said no. 2. Whether they would allow TDC to stop any CPO bid at any time during the process without penalty, they said no. 3. Whether they would accept an "airport uses only" covenant they said no. Further, I dont consider what I know of the Riveroak business case strong enough to convince an objective judge that economic, environmental and social benefit to Thanet would result from granting a CPO."
So from the horses' mouth, via David Green, we know that RO won't disclose their funding, would be prepared to leave TDC financially exposed and do, potentially, have plans for that site other than aviation. Ahem, as we've said all along.

Thanet Council and RiverOak to hold meetings over Manston | Thanet Gazette

Thanet council and RiverOak will hold a series of meeting to discuss the possible compulsory purchase of the Manston airport site over the next thirty days.

George Yerrall, CEO RiverOak Aviation Associates said: "Both parties agree some serious, and confidential, talks will clarify any confusion and help iron out the difficulties to ensure a successful conclusion."

Chris Wells, Leader of Thanet District Council said "I have been calling for calm over recent weeks, and, along with George, hope the campaigners will now respect that request."

The statement issued jointly describes it a 'significant step forward' and hopes to avoid a repeat of 'misunderstandings' in recent weeks.


The two will update progress on negotiations in the next thirty days with statements on their websites.

The airport closed in May 2014 and has been given the name Stone Hill Park by owners Chris Musgrave and Trevor Cartner who aim to create a mixed use development on the site.

Looking at previous posts, lorry parking. There's a lot more to be done before the runway will be used other than removing some paint.

At 10am this morning, Monday 7th September a News Article was posted on the Thanet District Council website.
It states that there is a joint statement from TDC and RiverOak, and that further meetings will take place.

Manston Airport: Key statements and letters have just been published by RiverOak.

Well it would appear that USA firm RiverOak have finally lost all patience with the leader of TDC, Councillor Chris Wells.
On the RiverOak website they publish both the latest letter from Chris Wells, to them (apparently the cumulation of the 30 days that Chris Wells has spent in silence), and George Yerrall's reply to Chris Wells.

The RiverOak reply to Chris Wells starts :
"I am disappointed and distressed because your response leaves me with the clear message that you have no interest in doing a CPO with RiverOak in your role as the Leader of TDC. "
But ends with the statements :
"We’re still here and we are ready to execute our Indemnity Agreement, immediately. We hope to move forward in a more open and transparent process.
Thirty days have come and gone. The only “progress” we have made is that we are now certain that you have no interest in a CPO."


The Save Manston Airport association thank RiverOak for continuing to battle the stonewalling by Councillor Chris Wells, and for aiding the people of Kent and their elected representatives in Thanet District Council, in their declared wish to return Manston Airport to Aviation use. The 9,200 members of SMA will continue to do anything reasonable we can towards this aim .
