Foreign pilots covered under Workers Comp?
 

Does anyone know whether a foreign national (Non SA citizen), working for a South African company, can also benefit from the Workers Compensation Fund?

I know a pilot who was recently injured while working for a South African contract company. He is now unemployed (temporarily medically unfit) and without an income. I find it hard to deal with that this excellent guy has to suffer at the moment while he could be eligible for financial compensation.

I would like to see that he is able to benefit from this aid we as S.Africans have.

Any info will be appreciated.

Nationality does not come into it. If he was an employee of the company, he is entitled to the same benefits as any other.

Might be different if he was a employed on a sub-contract basis. But if he was an ordinary employee, in SA on a permanet redident permit, it makes no difference if he's a South African citizen or not.

Not sure what the WCA "cut off" is in terms of who gets benefits and who doesn't? There used to be a salary thresshold: below that, you were classified as a "workman" and were cxovered under WCA: over that, you weren't and your only recourse was to claim against the employer under "employers liaiblity".

Think the rules might have changed in the last few years, so that ALL employees are now "workmen".

As for pilots, I dunno...you need to check with the WCA commissioner's office or a labour specialist.
