@ Jonzarno made a point, a few posts up.....the plaintiff should file their plaint (go to Court) at the court where the alleged took place...so that would be the one nearest to you (where you wuz robbed
)
The defendant has the right to ask for proceedings to be transferred to
his "home patch"
The downside for him, if he loses,is as
jonposted.....he's liable for your expenses.
the whole concept of "small claims" was that it should be cheap and simple.
my last case I took out, the defendant ,when i corresponded with him, used a solicitor to try to intimidate me....so I just racked up a bit more correspondence, as those bills are specifically excluded lawyers fees are
notallowable in a small claim. He asked that the case be heard at his local court.....ok , an inconvenience to me, but I won , got all I'd claimed and the judge prompted me for the expert report cost, loss of earnings, travel etc.
So, if you're owed goods or refund, GO FOR IT!
