There's no mention of Mr Jones's previous conviction in the judgement, but then nor would that be expected (or permitted, probably).
This was a civil dispute, and it's likely his previous conviction was 'spent' under rehabilitation of offenders (Usually 4 years from end of sentence for sentences of under 2 years 6 months, so Feb this year)
