Yes, the final responsibility is the pilots. When two aircraft are in cloud, moot point? Kinda points out the woefully inadequate airspace classification when we can say:
'pilots responsibility to see and avoid'
'but they were in cloud, can't see each other'
'stiff ****, that's their problem'
