I find it difficult how someone could forget they had a class 2, but as far as I know the initial class 1 makes no allowances for a previous class 2 so the actual examination would not have been changed. Therefore the poster passed a class 1 examination and in medical terms at least is fit to exercise its privileges. The Authority may indeed take a dim view, court marshal him or sentence him to life imprisonment
but meanwhile I fail to see why he cant fly. If you are being prosecuted for low flying, endangering an aircraft etc etc you can keep flying pending the court case unless and until your license is suspended
