The CAA admitted the risk of incapacitation had fallen so as to make the current limits nonsensical on medical grounds - ie the risk was well below the level of risk they have set as a cut off. I dont think the risk is debated between the parties, although it my be on this thread. It is a question of whether the regulator is required to change the rules when the facts change, and whether the rule should be changed
