Brazil is part of the civilised world. Legacy pilots will be released soon...

FL370 was their last cleared altitude. 'Cleared' means assigned by ATC. We do not change our altitude or flight plan without contacting ATC. Should contact be lost, again, we wait the specified time...

1.) Flight plan is only a plan when in controlled airspace. While routing can be autonomous, ATC must approve altitude changes. When we have known lost commumications, follow the ICAO 7 min rule....

Military radar surveillance systems, whether ground-based or airborne can easily determine the altitude of a target without mode C data or with no transponder signal at all.
